CONSTRUCTION MANAGER’S SERVICES. Construction Manager shall act as the District’s agent to render the services and furnish the work as described in Exhibit “A,” which will commence upon the receipt of a Notice to Proceed signed by the District representative. Construction Manager’s services will be completed in accordance with the schedule attached as Exhibit “C.”

Should the Owner and the Construction Manager not reach an agreement on the GMP, fees or other terms and schedules, the Owner reserves the right to cease negotiations for that project and perform the work by other means without affecting the Agreement or any other project. The Owner reserves the right to solicit written proposals from other Construction Managers or contractors and award to the lowest responsive, responsible contractor. 2.2 For each project, the Construction Manager shall commence the Work within ten (10) calendar days after receipt of the Notice to Proceed from the Owner. 2.3 Pre-Construction Services- Basic services may include pre-construction services, including without limitation, reviewing designs during development for feasibility of construction methods, availability of materials and labor, providing detailed costs estimates of the Cost of the Work developed by using estimating techniques which anticipate the various elements of each Project, advising on the separation of each Project into contracts for various categories of work, developing a construction schedule and developing a GMP for the Work. If pre-construction services are to be provided, Owner shall direct so in the Activation. As part of any pre-construction review, the Construction Manager shall, in accordance with current project schedule requirements, review applicable Construction Schedule, the Total Project Construction Cost, fees for permits and licenses, if any, modifications necessitated by local conditions, other information for a full understanding of each Project, and the Construction Documents. The Construction Manager shall: A. Review the Construction Documents for clarity adequacy of detail, consistency, accuracy and completeness. B. Identify conflicts, omissions or overlaps in the proposed division of work, evaluate the completeness of the intended bid categories, and identify unusual design details affecting construction cost and schedules. C. Apply established value engineering principles and practices to reduce the cost of each Project....

CONSTRUCTION MANAGER’S SERVICES. The services which the Construction Manager shall provide include, but are not limited to, those described or specified herein. The Construction Manager shall comply with all federal, state and local governmental laws, rules and regulations applicable to the services to be performed under this Agreement as well as the requirements of the Florida Building Code (FBC) and Florida Fire Prevention Code, in effect as of the date the building permit(s) is issued. The Construction Manager acknowledges that the Owner shall be the Authority Having Jurisdiction to decide and determine all questions under the Florida Building Code and the requirements of this Agreement regarding construction of the project herein described. Upon execution of this Agreement, the construction Manager shall commence performance of Pre-Construction Services and upon execution of a Partial GMP Amendment (see Article 1.2), the Construction Manager shall commence provision of Construction Services. The parties acknowledge that (i) the Owner may determine not to proceed with Construction Services, (ii) performance of Pre-Construction Services may overlap performance of Construction Services, (iii) categories of work performed during Construction Services may be performed in separate phases, and (iv) payment of the Construction Manager for Pre-Construction Services shall be separate from payment, if any, for Construction Services.

CONSTRUCTION MANAGER’S SERVICES. The term of this Agreement shall be from May 13, 2020 through April 30, 2023. Construction Manager shall act as the District’s agent to render the services and furnish the work for each assigned Project as described in Exhibit “A,” which will commence upon the receipt of a Notice to Proceed signed by the District representative. Construction Manager’s services will be completed in accordance with the schedule attached as Exhibit “C.” Time is of the essence and failure to perform work on time as specified in this Agreement is a material breach of this Agreement. If the time to complete its Services under Exhibit “C” exceeds three (3) years, the District may, at its sole discretion, extend the term of this contract for two separate option periods: Option Period 1) May 1, 2023 to April 30, 2024; Option Period 2) May 1, 2024 to April 30, 2025. District may exercise its options by providing written notice to Construction Manager no less than ninety (90) days before the contract expiration date. The total duration of any associated contract shall not exceed five (5) years.
CONSTRUCTION MANAGER’S SERVICES. 1.1 Construction Manager shall provide sufficient home office organization and support, personnel and management to carry out the requirements of this Agreement in an expeditious and economical manner consistent with the interests of the District. 1.2 Construction Manager shall prepare and periodically update a Project Schedule for the Architect’s review and the District’s acceptance. Construction Manager shall obtain the Architect’s approval for the portion of the preliminary Project Schedule relating to the performance of the Architect’s services. In the Project Schedule, Construction Manager shall coordinate and integrate Construction Manager’s services, the Architect’s services and the District’s responsibilities with anticipated construction schedules, highlighting critical and long-lead-time items. 1.3 Construction Manager shall consult with the District and Architect regarding the Construction Documents and make recommendations whenever design details adversely affect constructability, cost or schedules. Construction Manager shall review the contract document submissions and provide written comments on the coordination of the various disciplines, including civil, structural, architectural, mechanical, electrical, plumbing and landscape. 1.4 Construction Manager shall provide recommendations and information to the District and Architect regarding the assignment of responsibilities for temporary Project facilities and equipment, materials and services for common use of the Contractors. Construction Manager shall verify that such requirements and assignment of responsibilities are included in the proposed Contract Documents. 1.5 If applicable, Construction Manager shall assist the District in developing and implementing a plan for temporary housing of students and staff. 1.6 Construction Manager shall provide recommendations and information to the District regarding the allocation of responsibilities for safety programs among the Contractors. 1.7 Construction Manager shall advise on the division of the Project into individual Contracts for various components of work. If multiple contracts are to be awarded, Construction Manager shall review the Construction Documents and make recommendations as required to provide that (1) the work of the Contractors is coordinated, (2) all requirements for the Project have been assigned to the appropriate Contract(s), (3) there are no gaps, overlaps or missing scope in the work assigned to various Contract(s), and (4)...
