CONTRACT DEEMED EXECUTORY. The CONSTRUCTION MANAGER agrees that the Contract shall be deemed executory to the extent of moneys available from either (i) the proceeds of bonds issued by the Authority for the Contract, or (ii) moneys made available by the Client for the Contract, or (iii) other non-Authority moneys made available from whatever source specifically for the Contract and no liability shall be incurred by the Owner beyond moneys available therefore.

CONTRACT DEEMED EXECUTORY. This Contract shall be deemed executory only to the extent of the monies appropriated and available for the purpose of the contract, and no liability on account therefor shall be incurred beyond the amount of such monies. It is understood that neither this Contract nor any representation by any public employee or officer creates any legal or moral obligation to request, appropriate or make available monies for the purpose of the Contract.
CONTRACT DEEMED EXECUTORY. A. The PO shall be deemed executory only to the extent of the funding available and RGRTA shall not incur any liability beyond the funds annually budgeted. RGRTA may make reductions in the PO for losses/reductions in its sources of revenue.
