Common use of Contract Design Clause in Contracts

Contract Design. The parties understand and acknowledge that the need for the Contract Services is episodic, but often time sensitive due to specific circumstances (e.g., vessel danger to people, property, environment). The parties further understand and acknowledge that the underlying competitive solicitation that resulted in the multiple Contract awards was designed to provide eligible Purchasers with competitive pricing for the Contract Services. Accordingly, as a procurement integrity matter, it is essential that Contractor both timely provide proposed Contract pricing for Purchaser work requests and that such pricing be independent and competitive.
