CONTRACTOR QUALIFICATIONS AND REQUIREMENTS. DES reserves the right to require receipt of proof of compliance with any of the requirements in this section within 10 Calendar days from the date of request, and to terminate this Contract as a material breach for noncompliance with any requirement of this paragraph. Contractor shall maintain compliance with these requirements throughout the life of this Contract.
CONTRACTOR QUALIFICATIONS AND REQUIREMENTS. 4.1 EACH BIDDER MUST PROVIDE WITH THEIR BID PROOF OF LICENSING BY THE STATE OF ALABAMA BOARD OF ELECTRICAL CONTRACTORS. FAILURE TO PROVIDE SAID DOCUMENTATION WILL RESULT IN REJECTION OF THE BID. PROOF OF INDIVIDUAL CERTIFICATIONS FOR EACH JOURNEYMAN ELECTRICIAN SHALL ALSO BE INCLUDED. 4.2 ALL LEGAL AND REGULATORY PROVISIONS OF TITLE 34 SECTION 36 CODE OF ALABAMA, AND THE ADMINISTRATIVE RULE AND REGULATIONS OF THE STATE OF ALABAMA BOARD OF ELECTRICAL CONTRACTORS ARE HEREBY INCORPORATED INTO THESE SPECIFICATIONS BY REFERENCE. 4.3 EACH BIDDER MUST PROVIDE WITH THEIR BID A MINIMUM OF TWO (2) COMMERICAL REFERENCES TO DOCUMENT A MINIMUM OF THREE (3) YEARS TOTAL EXPERIENCE IN ELECTRICAL SERVICES FOR FACILITIES OF A SIMILAR SIZE, NATURE AND SCOPE TO THE FACILITY FOR WHICH HE IS SUBMITTING A BID. EACH REFERENCE MUST INCLUDE COMPLETE CONTACT INFORMATION. 4.4 IN THE EVENT THAT A BIDDER IS UNWILLING OR UNABLE TO ACCEPT ANY SPECIFIC CONDITION OR STIPULATION OF THIS SPECIFICATION, HE SHALL INCLUDE AN ATTACHMENT TO HIS BID A LIST OF SAID EXCEPTIONS. IN THE UNLIKELY EVENT THAT SUCH A BID IS THE SOLE BID RECEIVED FOR A SPECIFIC COUNTY, THE DEPARTMENT OF TRANSPORTATION MAY, AT ITS SOLE DISCRETION, ELECT TO WAIVE MINOR SPECIFICATION REQUIREMENTS SO EXPECTED. HOWEVER, THE DEPARTMENT ASSUMES NO OBLIGATIONS, NEITHER EXPRESSED NOR IMPLIED, TO EXERCISE THIS DISCRETION IN REGARD TO ANY INDIVIDUAL OR CUMULATIVE BID REQUIREMENT. 4.5 A BIDDER’S FAILURE TO DOCUMENT ANY EXCEPTIONS TO THE BID SPECIFICATIONS SHALL BE CONSTRUED AS AN AFFIRMATIVE DECLARATION THAT THE BIDDER, BY HIS SIGNATURE ON THE BID DOCUMENT, ACCEPTS AND AGREES TO ALL STIPULATIONS OF THE BID SPECIFICATION.
