Contracts (Privity. Act: For the purposes of the Contracts Privity Xxx 0000, each attorney appointed under this Agreement is entitled to enforce against the Customer each provision of this Agreement which confers a benefit on such attorney. However, no such attorney need consent to any amendment made to this Agreement.
Contracts (Privity. The Customer acknowledges that Debitsuccess has been contracted by the Facility to collect the instalments due under this Contract and the Customer acknowledges that all rights of the Facility pursuant to this Contract are able to be enforced by Debitsuccess as if it were the Facility, without any involvement on the part of the Facility or the consent of the Customer.

22.1 Except where expressly provided for in this agreement, this agreement shall not and is not intended to confer any benefit on or create any obligation enforceable at the suit of any person not a party to this agreement.

Except as expressly provided in clause 6.6(a) above, the parties do not intend to create rights in, or grant remedies to, any third party as a beneficiary to this Agreement, and all of the provisions of this Agreement shall be for the sole and exclusive benefit of the parties. You acknowledge that Pharmac may pursue damages or any other claim (including injunctive or other such relief) under this Agreement on its own account and/or on behalf of Health NZ.
Contracts (Privity. (a) For the purposes of the Contract and Commercial Law Xxx 0000, we both acknowledge that your obligations in this Agreement constitute promises which confer or are intended to confer a benefit on DHB Hospitals and Ministry of Health and related persons.
(b) Except as expressly provided in paragraph (a) above, the parties do not intend to create rights in, or grant remedies to, any third party as a beneficiary to this Agreement, and all of the provisions of this Agreement shall be for the sole and exclusive benefit of the parties.
(c) For the avoidance of doubt, you acknowledge that PHARMAC may pursue damages or any other claim (including injunctive or other such relief) under this Agreement on its own account in respect of any form of loss or damage incurred by PHARMAC and/or DHB Hospitals or the Ministry of Health.
Contracts (Privity. The provisions of this Agreement that are expressed to confer rights on any Subsidiary of any party or any other person are for the benefit of, and intended to be enforceable by, each such Subsidiary or other person in accordance with the Contracts (Privity) Act 0000. Xotwithstanding the foregoing, the provisions of clause 6.3 and Schedule 5 are not intended to create any obligation for the benefit of, or be enforceable by, any third person to whom any obligations are owed in respect of any Misplaced Asset or Misplaced Liability.
Contracts (Privity. The parties acknowledge that, in terms of the Contract and Commercial Law Axx 0000, this Deed is made for the benefit of and is intended to be enforceable by the Senior Creditor and any receiver appointed by it.
Contracts (Privity. This Deed and each relevant Series Supplement:
(a) is legally enforceable between the Supervisor, the Issuer and the Holders;
(b) shall be enforceable for the benefit of every Holder from time to time except that, for the purposes of the proviso to section 4 of the Contracts (Privity) Xxx 0000 of New Zealand, the benefit so extended to Holders is intended to be limited by, and enforceable subject to, the terms of this Deed including:
(i) the rights of parties to this Deed to vary or discharge benefits or obligations as provided in this Deed without the consent of any Holder, other than as so provided; and
(ii) the restrictions in the Transaction Documents on a Holder taking action other than through the Supervisor.
