Correction of Faults. 1. Exchange will use reasonable efforts to resolve any Fault during Support Hours which is either notified to it by the Customer or communicated to it by any automatic alarm system which may be incorporated in the System by either supplying such information and instructions to the Customer, or making such corrections and adjustments to and replacing such Parts of the System a may be reasonably necessary to restore the System to its full and proper function and specification. 21.10.2. Exchange will use its reasonable endeavours to give an initial response to requests for Support with 2 Support Hours for Major Faults within 4 Support Hours for Minor Faults unless specified otherwise in the applicable Schedule B. 21.10.3. Exchange may, in order to comply with any of its obligations under this Agreement, replace the System or any part thereof provided that the replacement System or Part shall be similar in all materials respects in specification and performance to the original.

  • Correction of Defects 35.1 The Engineer shall give notice to the Contractor of any Defects before the end of the Defects Liability Period, which begins at Completion and is defined in the Contract Data. The Defects Liability Period shall be extended for as long as Defects remain to be corrected. 35.2 Every time notice of a Defect is given, the Contractor shall correct the notified Defect within the length of time specified by the Engineer’s notice.

  • FALSE STATEMENTS; BREACH OF REPRESENTATIONS The Parties acknowledge that this Agreement has been negotiated, and is being executed, in reliance upon the information contained in the Application, and any supplements or amendments thereto, without which the Comptroller would not have approved this Agreement and the District would not have executed this Agreement. By signature to this Agreement, the Applicant: A. represents and warrants that all information, facts, and representations contained in the Application are true and correct to the best of its knowledge; B. agrees and acknowledges that the Application and all related attachments and schedules are included by reference in this Agreement as if fully set forth herein; and C. acknowledges that if the Applicant submitted its Application with a false statement, signs this Agreement with a false statement, or submits a report with a false statement, or it is subsequently determined that the Applicant has violated any of the representations, warranties, guarantees, certifications, or affirmations included in the Application or this Agreement, the Applicant shall have materially breached this Agreement and the Agreement shall be invalid and void except for the enforcement of the provisions required by Section 9.2 of this Agreement.
