Cost Control and Reporting. Design Builder, with each submission of the Design and Construction Budget, shall: (i) show all estimated Project costs by individual line item; (ii) provide continual management of such control budget throughout the Project duration, identifying potential cost problems and potential solutions for Owner's approval; (iii) provide monthly reports (unless requested more frequently by Owner) with regard to the status of the total Construction Budget. Each of the budgets and schedules described above, together with any and all modifications and amendments thereto, shall be subject to the approval of Owner.

Cost Control and Reporting. The Design-Builder shall implement a Cost/Schedule Status Report (CSSR) program for Stage 2 Design-Build Work cost control, which system shall be disclosed to and reviewed and approved by the City and the Owner Representative prior to the GMP Amendment Date. The Design-Builder shall develop cash flow reports and forecasts as reasonably requested or required by the City and the Owner Representative, including a good faith calendar quarterly estimate of payments of the Stage 2 Design-Build Price throughout the Stage 2 Design-Build Period, specifying the range of minimum and maximum monthly payments, which shall not exceed the Guaranteed Maximum Price. The Design-Builder shall promptly (within seven days) after acquiring such information, identify and report to the City and the Owner Representative all variances between estimated costs and actual costs of the Stage 2 Design-Build Work, including any proposed corrective action to be taken by the Design-Builder.

During the pre-construction phase, the Construction Manager shall monitor regularly the Control Budget for the Project, including construction, general conditions and fees, and any other Project-associated costs. The Construction Manager shall advise the Owner’s designated representative immediately whenever a cost category estimate is tending to exceed funds budgeted. All cost control and reporting is to be based on data developed independently by the Construction Manager, separate from that of the Architect.
