Common use of Cost of Examinations Clause in Contracts

Cost of Examinations. Any costs for examination required by the Employer shall be paid by the Employer. Employees shall have the right to submit examination reports to the Employer which would respond to the questions of an employee’s ability to perform the material and substantial duties of his position. If the employee disagrees with said determination he may be examined by a physician of his choice at his expense. If the two (2) reports conflict a third opinion shall be rendered by a neutral physician chosen by the first two (2) physicians whose decision shall not be appealable to the grievance procedure. The neutral physician’s cost shall be shared equally by the employee and the Employer.‌
