Critical Areas Delineation and Technical Memo. A critical areas (wetland and stream) delineation is assumed to be necessary to aid in critical areas identification and avoidance of critical areas impacts along the corridor. No wetland or stream features are assumed to occur in the work areas at the time of scope preparation, but a detailed site reconnaissance has not yet been conducted to prepare this scope and all potential work areas are not yet known that may be known during the course of the project. Delineation field work and the project action will be limited to occur on city owned property and/or right-of-entry will have been approved by others prior to initiating any Consultant field work. One field day for two Consultant environmental staff is assumed for the delineation effort and flagged delineation features are assumed to be located and mapped by others under survey efforts. A technical memorandum will be produced following the delineation and mapping to characterize and rate wetland and steam critical areas along the project and apply standard buffers pursuant to the City code. If potential project-related critical areas impacts are identified, the Consultant will make the Client aware of this finding early in the project schedule and a supplemental scope and fee will be prepared for Client consideration and authorization to address any additional documentation and related impact/mitigation and permit processes if determined to be necessary. If prior delineations and mapping of critical areas exists for the corridor, that information will be evaluated if provided to the Consultant to confirm the necessity of conducting a new or updated delineation effort. No critical areas impacts for the subject project are known or assumed.   • Critical Infrastructure Subcontracts For purposes of this Paragraph, the designated countries are China, Iran, North Korea, Russia, and any countries lawfully designated by the Governor as a threat to critical infrastructure. Pursuant to Section 113.002 of the Business and Commerce Code, Contractor shall not enter into a subcontract that will provide direct or remote access to or control of critical infrastructure, as defined by Section 113.001 of the Texas Business and Commerce Code, in this state, other than access specifically allowed for product warranty and support purposes to any subcontractor unless (i) neither the subcontractor nor its parent company, nor any affiliate of the subcontractor or its parent company, is majority owned or controlled by citizens or governmental entities of a designated country; and (ii) neither the subcontractor nor its parent company, nor any affiliate of the subcontractor or its parent company, is headquartered in a designated country.
