Crossing Maintenance. Licensee shall be responsible for the cost of any and all maintenance necessary to the Road Crossing and any and all appurtenances thereto. Licensor acting as the agent of Licensee, may perform such work as is necessary in the sole judgment of Licensor, and Licensee shall, on demand, promptly reimburse Licensor the cost thereof, plus fifteen (15%) percent thereon as a charge for the supervision, accounting, and use of tools; or Licensor may terminate this License by giving Licensee not less than thirty (30) days advance written notice of its intention to do so.

Crossing Maintenance. Activities: • Use and maintain two vehicle fords across Shasta River. • Periodic use of wetted fords for crossing cattle at two designated crossings (same as vehicle fords). • Crossings will be maintained for crossing vehicles and watering and crossing livestock. • One instream stock watering only point will be maintained using panels or other effective livestock management equipment to limit access to approximately twenty-five linear feet of wetted channel to meet watering needs for up to 175 pairs. Herbicide/Fertilizer/Pesticide Use Activities: • Periodic use of herbicide to control invasive plants at hay barn. All facilities are more than 500’ from a stream.
Crossing Maintenance. Permittee shall provide site maintenance for the life of the structures, including, but not limited to, re-applying erosion control to minimize surface erosion and ensuring drainage structures, streambeds and banks remain sufficiently armored and/or stable. Permanent culverts shall be maintained and kept open year-round. Permittee is responsible for such maintenance as long as the culvert remains in the stream.

Prior approval for lesser amounts shall not be required for monthly or recurring operating charges or if emergency expenditures over the maximum are, in the Agent’s opinion, needed to protect the Property from damage, prevent injury to persons, avoid suspension of necessary services, avoid penalties or fines, or suspension of services to tenants required by a lease or rental agreement or by law, including, but not limited to, maintaining the Property in a condition fit for human habitation as required by applicable law.
