DASNY is. (i) a body corporate and politic constituting a public benefit corporation of the State of New York (the “State”), duly created and established and validly existing pursuant to the Dormitory Authority Act, being Chapter 524 of the Laws of 1944 of the State, as amended, and constituting Titles 4 and 4B of Article 8 of the Public Authorities Law of the State, as amended; (ii) the successor to the powers, duties and functions of the New York State Medical Care Facilities Finance Agency, duly created and established and validly existing pursuant to the New York State Medical Care Facilities Finance Agency Act, being Section 4 of Section 1 of Chapter 392 of the Laws of 1973, as amended; and (iii) the successor to the powers, duties and functions of the Facilities Development Corporation, duly created and established and validly existing pursuant to the Facilities Development Corporation Act, being Section 4 of Section 1 of Chapter 359 of the Laws of 1968, as amended (the “Enabling Legislation”).

  • SBC-13STATE shall provide to CLEC Interconnection of the Parties’ facilities and equipment for the transmission and routing of Telephone Exchange Service traffic and Exchange Access traffic pursuant to the applicable Appendix ITR, which is/are attached hereto and incorporated herein by reference. Methods for Interconnection and Physical Architecture shall be as defined in the applicable Appendix NIM, which is/are attached hereto and incorporated herein by reference.

  • SBC-12STATE 47.1.1 The terms contained in this Agreement and any Appendices, Attachments, Exhibits, Schedules, and Addenda constitute the entire agreement between the Parties with respect to the subject matter hereof, superseding all prior understandings, proposals and other communications, oral or written between the Parties during the negotiations of this Agreement and through the execution and/or Effective Date of this Agreement. This Agreement shall not operate as or constitute a novation of any agreement or contract between the Parties that predates the execution and/or Effective Date of this Agreement.

  • Publikace a) The Institution and the Investigator agree that the Sponsor shall have the sole and exclusive right to the first publication of the results of the Study. Such Sponsor publication is intended to be a multi-center publication of the Study results, collected from all investigators and institutions participating in the Study (the “Multi- Center Publication”). If the Investigator is interested in contributing to or participating in the Multi-Center Publication, he or she must contact the Sponsor. Selection of authors/participants will be governed by the Sponsor, considering individuals’ contribution to the Study.

  • Public Outreach The Sponsor is responsible for development and administration of a public outreach effort to ensure public awareness and involvement in the Project development and delivery process. The Sponsor shall provide a copy of the public outreach plan and all materials documenting the public outreach activities, including public notices, press releases, flyers, etc. to the Authority. The public outreach plan must accompany the first invoice for payment from Sponsor. The materials documenting the public outreach activities must accompany the final invoice for payment from Sponsor.

  • Body Armor In recognition of the need to enhance the personal safety of security personnel at DHMH and Correctional Facilities, the parties agree that non-probationary security personnel who have contact with forensic patients and/or inmates should generally have the opportunity to have individually fitted stab proof vests and, in addition, individually fitted bullet proof vests will be provided to officers on an “as-needed” basis. The sharing of vests shall not be considered an acceptable practice and vests may transferred from employee to employee only if such vests are a proper fit and are appropriately sanitized in accordance with practices necessary to eliminate the risk of the spread of MRSA and other communicable diseases. The parties agree to meet and agree to policies, including any limitations or exclusions, for the provision of stab proof vests to correctional officers and security attendants by January 31, 2008. In developing the policies, the committee shall:

  • International Shopping Goods estimated to cost less than $100,000 equivalent per contract may be procured under contracts awarded on the basis of international shopping procedures in accordance with the provisions of paragraphs 3.5 and 3.6 of the Guidelines.
