Databáze. Poskytovatel a Zkoušející odpovídají za zpracování a udržování přesné a úplné databáze všech Subjektů hodnocení dle Protokolu a Příslušných právních předpisů (dále jen „Databáze“). Poskytovatel a Zkoušející mohou používat Databázi pro své vlastní účely s výhradou povinností mlčenlivosti dle této Smlouvy. Poskytovatel a Zkoušející nesmí převádět ani jinak zpřístupňovat Zadavateli jakékoli osobní údaje Subjektů hodnocení, ledaže byly tyto údaje pseudonymizovány (byly z nich odstraněny identifikační znaky) nebo ledaže je takové zpřístupnění vyžadováno dle Příslušných právních předpisů nebo příslušnými státními orgány. Zadavatel může ustanovit některé své zaměstnance nebo externí prodejce (monitory klinických studií (clinical research associates – CRA)) k prověřování a kontrole přesnosti a úplnosti Databáze tak, aby byla v souladu s Příslušnými právními předpisy; tito CRA však nesmí sdělovat Zadavateli žádné osobní údaje Subjektů hodnocení.

Databáze. Zdravotnické zařízení a Zkoušející odpovídají za zpracování a udržování přesné a úplné databáze všech Subjektů hodnocení dle according to the Protocol and Applicable Law (“Database”). Institution and Investigator may use the Database for their own purposes, subject to the confidentiality obligations under this Agreement. Institution and Investigator shall not transfer or make in any other way accessible to Sponsor any personal data of Trial Participants, unless such data has been pseudonomized (de- identified) or if such disclosure is required under Applicable Law or requested by the competent state authorities. Sponsor may assign certain of its employees or external vendors (clinical research associates, “CRAs”) to review and control accuracy and completeness of the Database in order to comply with Applicable Law; however, such CRAs are restricted from disclosing any personal data of Trial Participants to the Sponsor.   • Data Encryption Contractor must encrypt all State data at rest and in transit, in compliance with FIPS Publication 140-2 or applicable law, regulation or rule, whichever is a higher standard. All encryption keys must be unique to State data. Contractor will secure and protect all encryption keys to State data. Encryption keys to State data will only be accessed by Contractor as necessary for performance of this Contract.

  • Metadata Bibliographical, structural & descriptive data of the Licensed Material as defined in Schedule 5.
