Common use of Day of Observance and Pay on Holidays Clause in Contracts

Day of Observance and Pay on Holidays. Unless otherwise provided in an Appendix, for holidays falling on a Saturday, the Friday before shall be observed as the holiday. For holidays falling on a Sunday, the Monday following shall be observed as the holiday. Employees required to work holidays shall be paid for such work in accordance with the appropriate Appendix. An employee must be eligible for leave benefits and in a pay status on the scheduled work day before and the scheduled work day following a holiday to be eligible for holiday pay. However, an employee who has successfully completed at least five years of County service and who retires at the end of a month in which the last regularly scheduled working day is observed as a holiday, shall be eligible for holiday pay if the employee is in a pay status the day before the day observed as a holiday. For employees who work other than a 5/8 schedule and the holiday falls on their scheduled day off, the employee will be given a deferred holiday. The employee and supervisor will jointly select another day (preferably within the same pay period) to take as a holiday. This section does not supersede the holiday bank or holiday pay language in an Appendix.
