De-Identification of PHI. Unless otherwise agreed to in writing by both parties, Business Associate and its agents shall not have the right to de-identify the PHI. Any such de- identification shall be in compliance with 45 C.F.R. sections 164.502(d) and 164.514(a) and (b).
De-Identification of PHI. Business Associate may de-identify any and all PHI, provided that the de-identification conforms to the requirements of 45 CFR § 164.514(b), and further provided that Business Associate maintains the documentation required by 45 CFR § 164.514(b), which may be in the form of a written assurance from Business Associate. Pursuant to 45 CFR § 164.502(d), de identified information does not constitute PHI and is not subject to the terms of the BAS.

De-Identification of PHI. Under 45 C.F.R. §164.502(d) (2), de-identified information does not constitute PHI and is not subject to the terms of this Agreement. The Business Associate may de-identify any and all PHI, provided
1. The de-identification conforms to the requirements of 45 C.F.R. §164.514(b),
2. The Business Associate maintains the documentation required by 45 C.F.R. §164.514(b), and
3. The Business Associate gives written assurance to the DES Covered Component that the Business Associate appropriately maintains the documentation required by 45 C.F.R. §164.514(b).
De-Identification of PHI. Business Associate may use PHI to create de-identified information in accordance with 45 CFR § 164.514(b).
De-Identification of PHI a. Creation and Use of De-identified Data. In the event Business Associate wishes to de-identify PHI, it must first submit its proposed plan for accomplishing the conversion to Covered Entity for Covered Entity's approval, which shall not be unreasonably withheld provided such conversion meets the requirements of 45 CFR § 164.514. Business Associate may use de-identified PHI only as directed or otherwise agreed to by Covered Entity.
De-Identification of PHI. Either party may de-identify any and all PHI, provided that such de-identification is performed in accordance with 45 CFR 164.514(b), and provided that any code or other means of record identification is not disclosed or maintained that would allow de-identified information to be re-identified.
De-Identification of PHI. Subcontractor may use PHI to de-identify PHI in accordance with the HIPAA Privacy Rule. De-identified information is not PHI. Subcontractor may use De-Identified Information only for research, to create comparative databases, to conduct statistical analysis, and to perform other studies.
De-Identification of PHI. Business Associate may Use PHI to create de-identiFied inFormation in accordance with 45 CFR § 164.514(b).
De-Identification of PHI. Business Associate may use PHI to create de-identified health information. Such data de-identification shall be performed in accordance with the California Health and Human Services Agency Data De-Identification Guidelines (Sept. 23, 2016), in consultation with CDPH. Business Associate may use de-identified data for purposes of developing COVID-19-related products and services.
De-Identification of PHI. Business Associate may de-identify PHI obtained from the Plan or NMMIP. Such de-identified data will be the exclusive property of Business Associate and will remain the property of Business Associate upon the termination or expiration of the Services Agreement, and Business Associate may use and disclose such de-identified PHI for any lawful purposes.
