Deadweight. (a) In the event that there is a deficiency in the actual deadweight of the VESSEL determined as provided in the Specifications, the Contract Price shall not be decreased if such deficiency is six hundred (600) metric tons or less below the Guaranteed Deadweight of thirty thousand (30,000) metric tons at assigned design draft. (b) However, the Contract Price shall be decreased by the sum of United States Dollars 600 (US$ 600) for each full metric ton of such deficiency being more than six hundred (600) metric tons. (c) In the event that there should be a deficiency in the VESSEL's actual deadweight which exceeds one thousand (1000) metric tons below the Guaranteed Deadweight, the BUYER may, at its option, reject the VESSEL and rescind this Contract in accordance with the provisions of Article X of this Contract, or may accept the VESSEL at a reduction in the Contract Price in the maximum amount of United States Dollars two hundred and forty thousand (US$ 240,000).

Deadweight. (a) In the event that there is a deficiency in the actual deadweight of the VESSEL determined as provided in the Specifications, the Original Contract Price shall not be decreased, if such deficiency is six hundred (600) metric tons or less below the Guaranteed Deadweight as specified in Paragraph 6 of ARTICLE I of this Contract. (b) However, the Original Contract Price shall be reduced by the sum of United States Dollars Eight Hundred (USD500.00) for each full metric ton of such deficiency in excess of the aforesaid six hundred (600) metric tons. (c) In the event that there is a deficiency in the actual deadweight of the VESSEL which exceeds One Thousand and Six Hundred (1600) metric tons below the Guaranteed Deadweight, the BUYER may, at its option, reject the VESSEL and rescind this Contract in accordance with the provisions of ARTICLE X of this Contract, or may accept the VESSEL with reduction in the Original Contract Price in the maximum amount of United States Dollars Five Hundred Thousand Only (USD500,000.00).
Deadweight. (a) In the event that there is a deficiency in the actual deadweight of the VESSEL (33800 MT) determined as provided in the Specifications, the Contract Price shall not be decreased if such deficiency is two hundred (200) metric tons or less below the guaranteed deadweight described in the Specification. (b) In the event that the actual deadweight of the VESSEL as determined in accordance with the Specifications is less than the Guaranteed Deadweight, the Contract Price shall be reduced by the sum of two thousand United States Dollars (US$2,000) for each full metric ton of such deficiency being more than two hundred (200) metric tons. (c) In the event of such deficiency in the actual deadweight of the VESSEL being eight hundred (800) metric tons or more, then the BUYER may, at its option, reject the VESSEL and rescind this Contract in accordance with the provisions of ARTICLE X hereof or accept the VESSEL at a reduction in the Contract Price as above provided for eight hundred (800) metric tons only, that is, at a total reduction of one million two hundred thousand United States Dollars (US$1,200,000).
Deadweight. (a) The Contract Price shall not be affected or changed by reason of a deficiency in the actual deadweight of the Vessel, being not more than Two Thousand (2,000) metric tons below the guaranteed deadweight at the xxxxxxxxx draft in the conditions as set out in the Specifications. (b) If the deficiency in the actual deadweight of the Vessel exceeds Two Thousand (2,000) metric tons below the guaranteed deadweight at the xxxxxxxxx draft, the Contract Price shall be reduced by the sum of United States Dollars One Thousand Four Hundred only (USD1,400) for each full metric ton of such deficiency in excess of Two Thousand (2,000) metric tons (but disregarding fractions of a ton) up to a maximum deficiency of Five Thousand (5,000) metric tons. (c) If the deficiency in the actual deadweight of Vessel is more than Five Thousand (5,000) metric tons below the guaranteed deadweight at the xxxxxxxxx draft, then, Buyer may, at its option, reject the Vessel in accordance with Article VI.4 and terminate this Contract in accordance with the provisions of Article X, or accept the Vessel with a total reduction in the Contract Price of United States Dollars Four Million Two Hundred Thousand only (USD4,200,000.-).
Deadweight. (a) If the Deadweight stipulated in Article I, is not attained and the reduction exceeds 7 % of the stipulated Deadweight, the BUILDER shall as full compensation for the loss caused thereby pay to the BUYER - for each metric ton of reduction in excess of the said 7 %. (b) The maximum compensation for any deficiency in Deadweight shall in any event not exceed (c) If the reduction in Deadweight is more than 15 % of the stipulated Deadweight the BUYER may cancel this Contract.

Deadweight. (a) The Contract Price shall not be affected or changed by reason of the actual deadweight tonnage determined as provided for in the Specifications being below the deadweight tonnage specified and required under Paragraph 3(c) of Article I of this Contract (hereinafter called the "Guaranteed Deadweight"), if such deficiency in the actual deadweight tonnage is not more than Seven Hundred (700) metric tons. (b) In the event that the actual deadweight of the VESSEL as determined in accordance with the Specifications is less than the Guaranteed Deadweight of the VESSEL, the Contract Price shall be reduced by the sum of United States Dollars Four Hundred and Fifty (U.S.$450.-) only for each full metric ton (but disregarding fractions of one (1) metric tons) more than Seven Hundred (700) metric tons deficiency, up to a maximum of One Thousand and Seven Hundred (1,700) metric tons below the Guaranteed Deadweight. (c) In the event of such deficiency in the actual deadweight of the VESSEL exceeds One Thousand and Seven Hundred (1,700) metric tons, then the BUYER may, at its option, reject the VESSEL and rescind this Contract in accordance with the provisions of Article X hereof, or may accept the VESSEL at a reduction in the Contract Price as above provided for One Thousand and Seven Hundred (1,700) metric tons only, that is, at a total reduction of United States Dollars Four Hundred and Fifty Thousand only (U.S.$450,000.-).
