Common use of Deemed Resignation Clause in Contracts

Deemed Resignation. An employee shall be deemed to have resigned on the date upon which leave pursuant to Clauses 21.01 (Maternity Leave), 21.02 (Parental Leave), or 21.07 (Pre-Placement Adoption Leave) commenced unless they advised the Employer of their intent to return to work one (1) month prior to the expiration of the leave taken pursuant to Article 21 (Maternity/Parental/Adoption Leave) or Clause 20.18 (Extended Child Care Leave) or if they do not return to work after having given such advice.

Deemed Resignation. An employee shall be deemed to have resigned on the date upon which he/she is expected to return from his/her leave pursuant to Clauses 21.01 9.1 (Maternity Pregnancy Leave), 21.02 9.2 (Parental Leave), or 21.07 (Pre-Placement and Adoption Leave) commenced unless they advised the Employer and 9.3 (Extension of their intent to return to work one (1) month prior to the expiration of the leave taken pursuant to Article 21 (MaternityLeaves), if he/Parental/Adoption Leave) or Clause 20.18 (Extended Child Care Leave) or if they do she does not return to work after having given such advicework.

Deemed Resignation.
