Definition of Employee Grievance. An employee grievance is defined as a dispute or controversy between the Company and one (1) or more employees which arises from: (a) The interpretation, application, administration or alleged violation of the provisions of this Agreement; or (b) Alleged abuse of discretion by management in its treatment of employees with respect to matters provided in this Agreement; or (c) Discharge or disciplinary action without just cause excepting: (i) Discharge for reasons of national security; (ii) Discharge of an employee whose performance is not up to expectations and who has not completed one-hundred and twenty (120) working days of service; (iii) Discharge of term employees in accordance with the terms of their contract and the provisions of the Collective Agreement as limited by Article 24.
