Denver. One (1) extra board to protect the Denver-Cheyenne, Denver-Xxxxxx Springs and Denver-Phippsburg and Denver-Bond pools, the Denver yard assignments and all road switchers, locals and work trains originating within these territories and extra service to any power plant and other extra board work.
Denver. Colorado. ENSR Phase I site assessment report dated April 2002 noted the following regulatory issues which have been resolved as set forth below:
a. Fluorescent bulbs, which contain mercury vapor, were being disposed of in the trash dumpster inconsistent with Colorado's Universal Waste Regulations (1007 CCR Section 273.13(e)). Used bulbs are now being stored and disposed of in compliance with applicable regulations.
b. Trucks were being washed with caustic cleaners and the waste water from these cleanings was being allowed to discharge into the city street and enter the storm water collection system, without appropriate safeguards and a Colorado NPDES minimal discharge permit (Regulation 61, Colorado Permit System Regulations). Facility has discontinued the practice, eliminating the need to secure a permit.
Denver. There shall be no responsibility of Sport-Xxxxx for delivery, freight, carriage, insurance or licenses and official authorizations for customs compliance, and custom duties for exporting.
Denver. With respect to the office space currently leased by SHI at 0000 Xxxxxxxx, Xxxxxx, Xxxxxxxx 00000, SHI shall assign the lease to HLRUS or its designee as of the Closing Date (the “Denver Lease Assignment”), which assignment shall be on terms substantially similar to the lease currently in effect for such office space and shall provide that liabilities in respect of such lease shall begin to accrue to the assignee upon such assignment.
Denver. To the extent authorized by, and subject to any Applicable Law and except as otherwise provided in this Agreement, Denver shall be responsible for any and all claims, damages, liability and court awards, including costs, expenses, and attorney fees, incurred as a result of any act or omission by Denver, or its officials, officers, employees, and agents in connection with the subject matter of this Agreement.
