Power Plant. Employees working in the Power Plant on a straight eight (8) hour shift shall report at such time as to be ready for work at the time their shift begins and shall not absent themselves from duty until relieved or directed to leave. Interruptions for lunch and for coffee shall not total more than forty (40) minutes in the 8-hour shift, and in no case during such interruptions shall employees leave the plant without proper and required attendance. All work assignments in any job classification in the Power Plant may be rotated, or periodically reassigned, among the licensed Power Plant personnel.
Power Plant. (a) The Concessionaire may, at its sole option and discretion, construct aPower Plant at the Site to utilise the bio gas generated from the treatment of the Sewage at the Varanasi STP to produce clean energy. The Concessionaire shall utilise the energy produced by the Power Plant to operate the Facilitiesand sell any excess energy to third party consumers during the Term, in accordance with all Applicable Laws.
(b) If the Concessionaire chooses to construct a Power Plant at the Site, then it shall undertake such construction in accordance with all Applicable Laws and after obtaining all necessary approvals and consents to construct the Power Plant at the Site.
(c) The Concessionaire shall not be entitled to any additional land, Construction Payments, or an extension of the Scheduled Construction Completion Date for construction of the Power Plant.
(d) The Concessionaire shall not be entitled to any additional O&M Payments for operating the Power Plant.
(e) The Jal Xxxxx and NMCG shall not be liable to the Concessionaire in any manner whatsoever if the quality or quantity of Sewage delivered to the Varanasi STP is not adequate or appropriate to produce sufficient biogas to operate the Power Plant.
(f) The ownership, rights and title to the Power Plant constructed by the Concessionaire shall vest with the Jal Xxxxx during the entire Term and thereafter.

Power Plant. Two Rolls-Royce Deutschland BR710A2-20 turbofan engines power the Aircraft. The engines produce 14,750 lb. of thrust up to 35°C (ISA+20°C) at sea level. The engine is assembled from seven sub-assemblies: fan rotor, intermediate fan casing, HP compressor, combustor/HP turbine, LP turbine, exhaust case and accessory gearbox. It has a single stage low-pressure fan driven by a two stage shrouded low-pressure turbine. A two-stage high-pressure turbine drives a ten-stage high-pressure compressor. The first four stages of the compressor are equipped with variable-pitch stators controlled by the engine’s Full Authority Digital Engine Control (FADEC). The combustor is an annular conventional flow type designed for low emissions and smoke control. A forced mixer exhaust is integrated with a two-door full flow type thrust reverser. The hydraulically operated thrust reverser system, with weight on wheels or wheel spin-up available, will deploy when the thrust reverser levers on the throttle quadrant are operated. For maintenance, the thrust reverser can be locked open. The engine has been designed for “on condition” type maintenance which requires periodic inspection of specific major components. Only those parts that show distress are replaced or overhauled. The periodic maintenance checks are established utilizing the MSG-3 process. The complete power plant assembly is detachable from the pylon as a unit.

Licensee shall: 1) Upon signature of this License Agreement, fund the six-month development of a working prototype of a Suncone collector by providing $50,000 at the beginning of each monthly interval starting upon the Commencement Date ; 2) Within eight months of the signing of this License Agreement, fund the development of a commercial Suncone collector ; 3) Within 36 months of the Commencement Date, fund the engineering of a solar power plant utilizing a Suncone array; 4) Provide the funding for the commercialization of Suncone technology on a global basis in a timely manner.

Power Plant. (i) To Contributor’s knowledge, except as previously disclosed to BKP by Contributor, as of the Effective Date, there are no actions, suits, arbitrations, governmental investigations or other proceedings pending and served or, to Contributor’s knowledge, threatened or pending but not yet served against the Power Plant before any court or Authority, except for (i) matters fully covered by insurance or (ii) mechanic’s liens being contested by Contributor.
(ii) As of the Effective Date, Contributor has not received any written condemnation notice from any Authority with respect to all or part of the Power Plant.
(iii) To Contributor’s knowledge, as of the Effective Date, there are no contracts relevant to the ownership and operation of the Power Plant except as set forth on Exhibit 8.1(y) attached hereto. To Contributor’s knowledge, each of the contracts set forth on Exhibit 8.1(y) attached hereto is in full force and effect and has not been amended or assigned, except as set forth on Exhibit 8.1(y) attached hereto. Contributor does not represent or warrant that any particular contract set forth on Exhibit 8.1(y) attached hereto will be in force or effect as of the Closing or that the parties to such contracts will not be in default under their respective contracts, and neither the existence of any default of any party under any such contracts nor the fact that any contract is not in effect as of Closing shall affect the obligations of BKP hereunder.
(iv) No party other than Power Plant Purchaser has any options, rights of first offer, or rights of first refusal to purchase all nor any portion of the Power Plant.
(v) None of Kings Plaza Lender, AOB or AOB II is a party as a debtor to or contemplates being the subject of a voluntary or involuntary proceeding as a debtor under Chapter 11 of Title 11 of the U.S. Code or under any state laws relating to debtors, or subject to any general assignment for the benefit of creditors, and each of Kings Plaza Lender, AOB and AOB II is solvent and able to pay its debts as they become due. None of Kings Plaza Lender, AOB, AOB II or the Power Plant is in the hands of a receiver nor is an application pending for a receiver for Kings Plaza Lender, AOB, AOB II or the Power Plant.
