Design Works. ‌ It is has provided the Council with all specifications, drawings and other documents to facilitate the design of the project and warrants that all documents and information provided to the Council are accurate and in accordance with any budget nominated by the Council to facilitate Council’s objectives with respect of the project and the Contract Works.

Design Works. In the event that as a result of a change the Contractor - subject to the Municipality's prior approval - executes additional design works, it shall be entitled for such additional design works for a sum equal to 5% of the approved cost of the Change. In any event the Contractor shall not be entitled for any over-head payments. Accordingly, the aforementioned 5% sum will be calculated of the actual price of the Works excluding any overheads.
