Designation of Affordable Units. A. Affordable Units shall be reasonably dispersed throughout the Project, be of the same size, and contain on average the same number of bedrooms as the other units in the Project; and be comparable with the design or use of other units in terms of appearance, materials and finish quality. The minimum bedroom size for any Affordable Unit shall be 70 square feet. The Owner shall allocate any housing services and amenities to the Affordable Units in the same manner as they are allocated to the market rate units and tenants of the Affordable Units shall have equal access to the Project's common areas as is given to the residents of the market rate units, provided that any fee charged for use of the common areas, mandatory housing services or for spaces reserved for individual Units shall be included in the rents allowed for the Affordable Units pursuant to Section 2.4 below.

Designation of Affordable Units. A. Affordable Units shall be (a) reasonably dispersed throughout the Housing Development Project; and (b) comparable to other Residential Units in the Housing Development Project in terms of appearance, materials, and finish quality. The Affordable Units shall have the same proportion of unit types (i.e., number of bedrooms) and average size as the market rate units (provided, however, that no Affordable Unit may have more than three bedrooms). The minimum bedroom size for any Affordable Unit shall be 70 square feet. Residents of Affordable Units shall have access to the same common areas and amenities that are available to residents of other Residential Units in the Housing Development Project. Any fee charged for use of the common areas, mandatory housing services or for spaces reserved for individual Units shall be included in the rents allowed for the Affordable Units pursuant to Section
Designation of Affordable Units. The designation of the Affordable Units shall be agreed upon between the Developer and the City. Attached hereto as Exhibit B is a site plan of the Project with the Affordable Units designated. The appearance, materials, finished quality, and amenities of the Affordable Units shall be comparable to the market rate units. Attached hereto as Exhibit C is a list of the amenities and finishes that will be featured in the units in the Project. The Affordable Units shall be constructed concurrently with or prior to the construction of the market rate units in the Project. The issuance of a Certificate of Occupancy for the market rate units (or portion of units in a phased project), is contingent upon completion and issuance of a Certificate of Occupancy for the Affordable Units (or proportionate share of Affordable Units in a phased project). The construction of the Project shall be in compliance with all the requirements of Article 62. The City will inspect the Affordable Units for compliance with this section prior to issuance of the Certificate of Occupancy for the project and the sale of the units.

  • How Are Distributions From a Traditional IRA Taxed for Federal Income Tax Purposes Amounts distributed to you are generally includable in your gross income in the taxable year you receive them and are taxable as ordinary income. To the extent, however, that any part of a distribution constitutes a return of your nondeductible contributions, it will not be included in your income. The amount of any distribution excludable from income is the portion that bears the same ratio as your aggregate non-deductible contributions bear to the balance of your Traditional IRA at the end of the year (calculated after adding back distributions during the year). For this purpose, all of your Traditional IRAs are treated as a single Traditional IRA. Furthermore, all distributions from a Traditional IRA during a taxable year are to be treated as one distribution. The aggregate amount of distributions excludable from income for all years cannot exceed the aggregate non-deductible contributions for all calendar years. You must elect the withholding treatment of your distribution, as described in paragraph 22 below. No distribution to you or anyone else from a Traditional IRA can qualify for capital gains treatment under the federal income tax laws. Similarly, you are not entitled to the special five- or ten-year averaging rule for lump-sum distributions that may be available to persons receiving distributions from certain other types of retirement plans. Historically, so-called “excess distributions” to you as well as “excess accumulations” remaining in your account as of your date of death were subject to additional taxes. These additional taxes no longer apply. Any distribution that is properly rolled over will not be includable in your gross income.

  • Particular Methods of Procurement of Consultants’ Services 1. Quality- and Cost-based Selection. Except as otherwise provided in paragraph 2 below, consultants’ services shall be procured under contracts awarded on the basis of Quality and Cost-based Selection.

  • Agreement with Respect to Continuation of Group Health Plan Coverage for Former Employees of the Failed Bank (a) The Assuming Institution agrees to assist the Receiver, as provided in this Section 4.12, in offering individuals who were employees or former employees of the Failed Bank, or any of its Subsidiaries, and who, immediately prior to Bank Closing, were receiving, or were eligible to receive, health insurance coverage or health insurance continuation coverage from the Failed Bank ("Eligible Individuals"), the opportunity to obtain health insurance coverage in the Corporation's FIA Continuation Coverage Plan which provides for health insurance continuation coverage to such Eligible Individuals who are qualified beneficiaries of the Failed Bank as defined in Section 607 of the Employee Retirement Income Security Act of 1974, as amended (respectively, "qualified beneficiaries" and "ERISA"). The Assuming Institution shall consult with the Receiver and not later than five (5) Business Days after Bank Closing shall provide written notice to the Receiver of the number (if available), identity (if available) and addresses (if available) of the Eligible Individuals who are qualified beneficiaries of the Failed Bank and for whom a "qualifying event" (as defined in Section 603 of ERISA) has occurred and with respect to whom the Failed Bank's obligations under Part 6 of Subtitle B of Title I of ERISA have not been satisfied in full, and such other information as the Receiver may reasonably require. The Receiver shall cooperate with the Assuming Institution in order to permit it to prepare such notice and shall provide to the Assuming Institution such data in its possession as may be reasonably required for purposes of preparing such notice.

  • Other Methods of Procurement of Consultants’ Services The following table specifies methods of procurement, other than Quality and Cost-based Selection, which may be used for consultants’ services.
