Developer’s Response to Notice. (a) Promptly upon receipt of a notice under clause 8, the Developer must either: (i) rectify the breach identified in that notice within the time period specified in that notice; or (ii) notify the Council in writing that it does not agree that the breach identified in that notice has occurred, and refer the matter for dispute resolution in accordance with clause 12 and Schedule 7. (b) In the absence of a manifest error on the face of the notice, nothing in clause 1.1(a) of this Schedule will constrain or limit the Council’s rights of recourse under this Deed.
