Common use of Dismissal Notice and Pay Clause in Contracts

Dismissal Notice and Pay. When an employee is dismissed for cause other than dishonesty, insubordination, malfeasance or substance abuse, the Employer shall give the employee one (1) week (two (2) weeks for professionals) written notice of dismissal or pay in lieu thereof. If the cause is substance abuse, the employee shall be entitled to a medical leave of absence (or, at the Employer's discretion, may be continued on the job) if the employee enters an approved employee assistance program. If the employee refuses to attend or does not successfully complete the program, or if after completion of the program the employee again engages in substance abuse, this is grounds for immediate dismissal without further notice.
