Common use of Dismissal, Salary Reduction, Suspension Without Pay, Demotion, Written Reprimands Clause in Contracts

Dismissal, Salary Reduction, Suspension Without Pay, Demotion, Written Reprimands. (a) Pre-dismissal. A written notice shall be given to a regular status employee against whom a charge which may be cause for discharge, is presented. Such notice shall include the known complaints, facts and charges, and a statement that the employee may be discharged. The employee shall be afforded an opportunity to refute such charges or present mitigating circumstances to the Agency at a time and date set forth in the notice, which date shall not be more than seven (7) calendar days from the date the notice is received. The employee shall be permitted to have an official representative present. At the discretion of the Agency Head or designee, the employee may be suspended with or without pay or allowed to continue work as specified in the pre-dismissal notice. (b) A regular status employee reduced in pay, suspended without pay or demoted shall receive written notice of the discipline with the specific charges and facts supporting the discipline. (c) The Agency shall make a good faith effort to include the following statement on all written notices referred to in subparts (a) and (b) above:
