Common use of Dispensing of Medication Clause in Contracts

Dispensing of Medication. Bargaining Unit Members may be required to administer medication to pupils only under the following conditions: A. The parents or guardians have given prior written approval for the administration of medication by non–medical personnel. B. Written instructions from the attending physician must accompany a prescription. C. The Employer shall indemnify and save harmless from any liability Bargaining Unit Members who administer medication to pupils when directed to so do by school supervisory personnel. The Employer’s agreement to indemnify and save harmless shall apply only if the Bargaining Unit Member is acting in the course of that member’s employment in accordance with Board policy and has not engaged in any act or omission which constitutes gross negligence or intentional misconduct as that term is defined by law.
