Classified Employees a. The term "classified employee," when hereinafter used in this contract, shall be deemed to refer to and to rely only to service employees: 1. Who are in the classifications set forth in Exhibit A. 2. Whose normal work week is thirty (30) hours or more. 3. Who are employed regularly on a full-year basis. 4. All service employees other than classified employees are hereinafter referred to as non- classified employees.

The site supervisor shall assign the head custodian’s shift after consultation with the Association. If a site administrator anticipates changing the assignments, including room assignments, of custodians at the administrator’s site, the adminis- trator shall meet with the custodians prior to implementing the change. The custo- dians may be accompanied by an Association representative provided this accom- modation does not delay the assignment process. The custodians shall be pro- vided the opportunity for input on the proposed changes. Following the meeting the site administrator shall decide whether or not to implement the change. 2. Classified employees’ regular hours of work shall be the number of consecutive hours indicated above, exclusive of lunch. Such hours normally will be scheduled within the indicated range, Monday through Friday, unless the specific operational needs of the District require a different recurring work schedule. Should a different extended or permanent regular work schedule be needed for the employee(s), such needs will be discussed with the Association and affected employee(s) prior to implementation, and absent concurrence of the Association and affected em- ployees, the employee(s) with the least seniority will be assigned the different work schedules. An alternate employee may be assigned if they possess a special skill for which there is a verifiable operational need. 3. The regular work hours for classified employees shall include a regular, non- paid duty-free lunch period of at least thirty (30) minutes and a paid non-cumulative morning and afternoon break of at least fifteen (15) minutes. Classified Employees. 1. Custodians, maintenance and operations, mechanics, receiving and delivery work a thirty-seven and one-half (37.5) hour workweek. Additional hours may be assigned as required by workload and will be compensated according to the Fair Labor Standards Act. 2. Classified Employees may be assigned to shifts by their immediate supervisor based upon work requirements. The supervisor will make the final decision on who is assigned, changing work schedules and making assignments that fall outside the standard workday/week on an equitable basis. 3. Classified Employees may be required to work overtime whenever it is deemed necessary and falls outside the workday/week by the immediate supervisor. No employee shall be permitted to work overtime or restructure work periods without the prior approval of the immediate supervisor and/or administrator. 4. On a workday when worksites cannot be opened for the regular schedule due to extreme cold, severe snow or other emergencies, the District may announce an abbreviated schedule for that workday. On a workday when worksites cannot be opened for the regular schedule or an abbreviated schedule due to extreme cold, severe snow or other emergencies, the District may cancel the workday and may schedule a make‐up day. However, cooks' and bus drivers' schedules will be determined by their supervisor. Potential make‐up days may be identified on the school calendar for Classified Employees.
Classified Employees. 1. a. Classified employee who loses his position as a result of a layoff in any classification other than Maintenance Worker I shall have the right to a lower classification in his job progression ladder or any job in his Bargaining Unit he has previously held (except apprentice and trainee classifications) and for which he has completed the probationary period provided he has sufficient seniority in that classification series or previously held position.
Classified Employees. 1. The College will endeavor to maintain a minimum staffing level of 155 classified positions subject to the enrollment and financial condition of the College. 2. For the purpose of preserving work and job opportunities for the employees of Oakland Community College, the Employer agrees that types of work or services performed for the College by the collective bargaining unit shall not be subcontracted, with the exception of the items listed below: a) In the event that a supervisor determines, based upon available personnel and existing workload, that a specified project cannot be completed within a reasonable time frame, the College shall be permitted to contract the project so specified. b) Media Services Technician work relating to technology support that, in the past, has not been exclusively assigned to one bargaining unit. c) Any Media Services Technician audio or visual production that, in the past, has not been exclusively assigned to one bargaining unit or any Media Services Technician audio or visual production that is intended primarily for an external audience. d) In no event shall the subcontracting of work regularly and normally performed by the bargaining unit result in the layoff of any bargaining unit member. 3. When any new or expanded College facilities are established and the work to be performed fits Article 2, Recognition, and the job descriptions of the Classifications listed in Appendix D, the performance of all such work shall be performed by classified bargaining unit employees. The preceding does not prevent student workers from supporting classified employees in these new areas. When new classified vacancies are established by the College because of additional facilities, these positions shall be posted in accordance with Article 20, Vacancies/Postings. 4. When new or expanded programs are established by the College, the additional classified work shall be assigned equitably among the classified bargaining unit employees as agreed to in paragraph 1 above within the representational area in accordance with the job descriptions of the classifications list in Appendix D.

Classified Employees. If classified employees from the Xxxxx Trace School District wish to be considered for reemployment, they must indicate this to the superintendent, prior to May 1, of the year of their potential retirement. Their request must include a letter of resignation that states that their resignation is contingent upon being reemployed with the district. The resignation letter requested under this provision must be received by the superintendent 5 working days prior to the upcoming announced board meeting. If the request is received within 5 working days of a board meeting, the request may be tabled until the next scheduled board meeting. The superintendent will notify the classified employee of the board's decision on reemployment within 2 days of the board meeting. If a classified employee is rehired, retired classified employees will be placed at step 7 on the appropriate classified employee salary schedule. If the employee was not past this level on the salary schedule, they will be placed at the last level occupied. Rehired retired classified employees will progress on the salary schedule each year following their initial placement. Except as provided for under this agreement, all provisions of the contract will be maintained; however, a rehired retired classified employee will not be entitled to severance pay a second time. Rehired retired classified employees will NOT accrue seniority for the purposes of reduction in force. At their option, rehired retired classified employees will be eligible for board-provided single employee health insurance coverage at the contracted premium rate. Those rehired retired classified employees electing not to take such coverage shall be eligible for an annuity as per contract provisions for classified employees under the single plan. Rehired retired classified employees from the Xxxxx Trace School District will start out at up to 15 days sick leave, provided they had extra days accumulated that were not paid for as part of the severance package. Prior employment in the district is no guarantee of post-retirement employment or a particular assignment if reemployed with the district. Rehired retired classified employees shall be issued a one-year limited contract that shall automatically non-renew on each April 30th. The superintendent must notify each rehired retired classified employee prior to April 30th if he/she intends to renew the limited contract. Classified Employees. Membership and participation in the Teacher Retirement System (TRS) are optional and subject to the eligibility requirements established by the TRS. The District will withhold and forward a specified percentage, which is determined by the legislature, of the employeestotal salaries to the TRS. The District pays an administration fee for all employees that participate in the TRS.
Classified Employees. A. Whenever it becomes necessary to reduce the number of employees in a job classification, probationary employees in the classification affected shall be laid off first, followed by regular employees. B. Regular employees shall be laid off within their job classifications on the basis of job classification seniority, with the person with the least job classification seniority laid off first. If further layoffs are necessary, the person with the next least job classification seniority shall be laid off. An employee subject to layoff may exercise job classification seniority to displace another employee employed with less seniority within the job classification. Employees may only displace an employee who is on the same or lower tier of the job classification ladder as indicated in section 34.01, subject to the following: 1. The employee shall have all necessary skills, abilities and licenses or permits needed to perform the duties of the job without training, other than incidental training needed to familiarize the employee with the job. 2. The employee shall exercise his/her right of displacement prior to the first day of layoff. C. In refilling vacancies caused by layoffs, employees shall be recalled in the reverse order of layoffs. If employees do not respond within seven (7) calendar days to a written recall notice of reinstatement from the Administration, delivered by certified mail with return receipt requested, the employee's employment shall be deemed to be terminated. It will be the responsibility of the employee to provide the Administration with a current mailing address. One refusal for re- employment releases the Administration from any further responsibility to rehire the employee. D. All employees shall retain recall rights for a period of twenty-four (24) months from the date of their last day of work.
