Disposal of Hazardous Substances. Except as disclosed below, Company has not disposed of Hazardous Substances in such a manner as to create any material liability under any Environmental Law.
Disposal of Hazardous Substances. Neither the Borrower nor any Subsidiary will suffer, cause or permit the Disposal of Hazardous Substances at any property owned, leased or operated by the Borrower or any Subsidiary, except in the ordinary course of the Borrower’s business in material compliance with applicable Environmental Laws.
Disposal of Hazardous Substances. Except as disclosed on Schedule 5.14, the Borrower has not disposed of Hazardous Substances in such a manner as to create any material liability under any Environmental Law.
Disposal of Hazardous Substances. Suffer, cause or permit the Disposal of Hazardous Substances at any property owned, leased or operated by the Company or any Subsidiary, except in the ordinary course of the Company's business in accordance with applicable Environmental Laws.
Disposal of Hazardous Substances. Lessee will not dispose of any Hazardous Substance, regardless of the quantity or concentration, within the storm or sanitary sewer drains or plumbing facilities within the Premises or the Property. Any disposal of Hazardous Substances will be in approved containers, and Hazardous Substances will be removed from the Property or Premises only in accordance with the law. If Lessee knows, or has reasonable cause to believe, that any Hazardous Substance Release has come to be located on or beneath the Property or Premises, Lessee must immediately give written notice of that condition to Lessor, whether or not the Hazardous Substance Release was caused by Lessee.
Disposal of Hazardous Substances. Company was named in the late 1990s as a de minimis PRP for the cleanup of the Operating Industries, Inc. Superfund site (landfill) in Monterey Park, California for generating a small volume of non-hazardous wastes disposed at the landfill. Company, one of hundreds of PRPs, settled the matter by paying a de minimis settlement sum.
Disposal of Hazardous Substances. Except as set forth on Schedule 5.16, the Borrower has not disposed of Hazardous Substances, in such a manner as to create any material liability under any Environmental Law.
Disposal of Hazardous Substances. Ground Lessee, shall not dispose of any Hazardous Substances, regardless of the quantity or concentration, into any drainage ditches, storm, and/or sanitary sewer drains and plumbing facilities within the Premises, or other property of the College except in compliance with all Environmental Laws. Any disposal of Hazardous Substances shall be in approved containers and removed from the Premises by Ground Lessee in accordance with the law. If the College or Ground Lessee knows, or has reasonable cause to believe, that any release of Hazardous Substances has come to be located on or beneath the Premises, then the College or Ground Lessee, as the case may be, must immediately give written notice of that condition to the other Party.
Disposal of Hazardous Substances. 10.2.1 Subject to the provisions of subsection 10.3, the DBO Contractor shall cause to be identified Hazardous Substances affecting any portion of the Facility Lands and shall cause the storage, removal, transportation and disposal of Hazardous Substances in compliance with all applicable Contract Documents, Laws and Regulations, and the Environmental Management Plan attached hereto at Appendix 3. Except to the extent caused by the DBO Contractor or anyone for whom it is at law responsible, the DBO Contractor shall have no liability to the Owner for the presence of Hazardous Substances on the Facility Lands. The Owner shall pay all costs associated with the activities performed by the DBO Contractor pursuant to this subsection 10.2 except to the extent caused by the DBO Contractor or anyone for whom it is at law responsible. For the sake of greater clarity, the Owner is responsible for the presence of any pre- existing Hazardous Substances located upon the Facility Lands.
Disposal of Hazardous Substances. 10.2.1 The DBO Contractor shall cause to be identified Hazardous Substances affecting any portion of the Facility Lands and shall cause the storage, removal, transportation and disposal of Hazardous Substances in compliance with all applicable Contract Documents, Laws and Regulations, and the Environmental Management Plan attached hereto at Appendix 3.
