Hazardous Substance Release definition

Hazardous Substance Release means the threatened or actual spilling, discharge, deposit, injection, dumping, emitting, releasing, leaking, placing, migrating, leaching, and seeping of any Hazardous Substance into the air or into or on any land, sediment, or waters (including groundwater).
Hazardous Substance Release means any emission, discharge, release or threatened release into ambient air, surface water, ground water or lands of any pollutant, petroleum or its byproducts or derivatives, contaminant or chemical, industrial, hazardous or toxic material or waste, including those identified or defined in any Environmental Law.
Hazardous Substance Release means the spilling, discharge, deposit, injection, dumping, emitting, releasing, leaking, migrating, leaching, placing, or seeping of any Hazardous Substances into the environment, including air, land, sediment, water, groundwater, and storm water, in violation of any applicable Environmental Law, except as specifically authorized by a valid permit issued under applicable Environmental Laws.

Examples of Hazardous Substance Release in a sentence

  • Each Facility User will be responsible for all Environmental Costs (defined below) associated with investigation of, response to, or abatement of any Hazardous Substance Release (defined below) in the vicinity of Port marine terminal facilities, and/or on Port property that emanate from, are related to, or are caused by the Facility User’s vessel, equipment, activities, or operations.

  • If additional testing does not disclose any Hazardous Substance Release, the reasonable cost of the additional testing shall be paid for by the County.

  • Licensee shall promptly undertake all remedial and/or removal actions necessary or appropriate to ensure that any Hazardous Substance Release is eliminated and that any violation of any Environmental Law or environmental provision of this Agreement is cured or corrected.

  • Licensee shall also be liable for any Hazardous Substance Release on the Operating Area or on other properties or in the air or in adjacent or nearby waterways (including groundwater) as a result of or in connection with Licensee’s occupancy or use of the Operating Area which occurs during the Agreement Term or which occurs or continues after the Agreement Term.

  • Licensee shall conduct an exit environmental audit (the "Exit Audit") of its Operating Area to determine (i) its environmental condition, (ii) whether any Hazardous Substance Release has occurred or exists on or about its Operating Area, and (iii) whether there have been any violations of Environmental Laws or the environmental provisions of this Agreement.

  • In the event of a violation of an Environmental Law, a violation of an environmental provision of this Agreement, or a Hazardous Substance Release or the threat of or reasonable suspicion of the same for which Licensee is responsible under this Agreement, Licensee shall immediately undertake all acts necessary or appropriate to cure or correct the violation or investigate, contain and stop the Hazardous Substance Release.

  • Licensee shall be liable for any Hazardous Substance Release which occurs during the Agreement Term on the Operating Area arising out of or caused by, in whole or in part, directly or indirectly, from acts or omissions from Licensee's use of the Operating Area.

Hazardous Substance Release includes the spilling, discharge, deposit, injection, dumping, emitting, releasing, placing, leaking, migrating, leaching, and seeping of any Hazardous Substance into the air or into or on any land, sediment, or waters, except any release in compliance with Environmental Laws and specifically authorized by a current and valid permit issued under Environmental Laws with which Lessee is in compliance at the time of the release, but not including within the exception any such release in respect of which the State of Michigan has determined that application of the State’s Hazardous Substance removal and remedial action rules might be necessary to protect public health, safety, or welfare, or the environment.
Hazardous Substance Release means the spilling, discharge, deposit, injection, dumping, emitting, releasing, leaking or placing of any Hazardous Substance into the air or into or on any land or waters, except as authorized by a then-current and valid permit issued under applicable Environmental Law.

As used in this Agreement, the following definitions shall apply:
Hazardous Substance Release shall be interpreted in the broadest sense to include, but not be limited to, the spilling, discharge, deposit, injection, dumping, emitting, releasing, leaking or placing of any Hazardous Substance into the air or into or on any land or waters, except in compliance with Environmental Laws, the terms of this Lease, or as authorized by a then current and valid permit issued under applicable Environmental Laws.
Hazardous Substance Release solid waste" or "disposal" which is broader than that specified in either OPA, CERCLA or RCRA, such broader meaning shall apply.
Hazardous Substance Release means any intentional or unintentional entry of any Hazardous Substance into the environment, including but not limited to the abandonment or disposal of containers or Hazardous Substances.

  • Hazardous Substance means any chemical, pollutant, waste or substance that is (a) listed, classified or regulated under any Environmental Law as hazardous substance, toxic substance, pollutant, contaminant or oil or (b) any petroleum product or by product, asbestos containing material, polychlorinated biphenyls or radioactive material.

  • Hazardous condition means any situation involving the actual, imminent or probable spillage, leakage, or release of a hazardous substance onto the land, into a water of the State or into the atmosphere which creates an immediate or potential danger to the public health or safety or to the environment.
