Distribution of Award. The Holding Units and Money Market Shares under your Award will be distributed to you in accordance with your year 2002 offering Distribution Election Form. If you fail to submit a properly completed year 2002 offering Distribution Election Form on a timely basis, the Holding Units and Money Market Shares under your Award will be distributed in a lump sum on or about the third anniversary of the Date of Grant of your Award, unless the Committee determines otherwise, in its sole discretion.

Distribution of Award. All awards and damages received on account of any Taking, whether partial or total (including all amounts in respect to both the Premises, improvements constructed thereon, and personal property located thereon or thereat), including interest received, if any, whether such award or damages are paid in respect to the Taking of the fee or leasehold interest in the Premises (hereinafter collectively referred to as the “Award”), shall be paid promptly by the person(s) receiving the same to an escrow agent mutually acceptable to Landlord and Tenant, to be released as hereinafter provided upon appropriate instruction from the parties hereto.
Distribution of Award. If a part or all of the Premises is --------------------- taken, all compensation awarded upon such taking shall belong to and be paid to Landlord, except that Tenant shall receive from the award a sum attributable to Tenant's movable property or trade fixtures on the Premises which Tenant has the right to remove from the Premises pursuant to the provisions of this Lease, but elects not to remove; or, if Tenant elects to remove any such property or trade fixtures, Tenant shall receive a sum for reasonable removal and relocation costs not to exceed the market value thereof on the date possession of the Premises is taken.

Upon the Distribution Date, a number of Shares attributable to Your Vested Award shall be distributed to You as elected under Section VI of the Plan, free and clear of any restrictions (other than restrictions arising by operation of law and the Company’s Xxxxxxx Xxxxxxx Practice). However, with respect to a Vested Award under Section 2(c) of this Agreement, distribution of the Shares shall be made to Your legal representative within 30 days following Your date of death.
Distribution of Award. All compensation awarded upon a taking governed by Paragraph 16.1 or Paragraph 16.2 shall belong to and be paid to Landlord, except that Tenant shall be entitled to make a separate claim to the taking authority for all losses it suffers as a consequence of the taking, including losses relating to loss of use of the Additional Improvements.
Distribution of Award. The entire award or compensation in such eminent domain proceeding, whether for a total or partial taking or for diminution in the value of the leasehold or for the fee, shall be distributed to Landlord; provided however, that Tenant may apply for award of the value of Tenant's Trade fixtures or other personal property, loss of income, relocation costs, improvements and the value of the leasehold interest created hereby, according to the law in effect in the jurisdiction where the Premises are located, so long as such award does not diminish the value of Landlord's award. In the event that a separate award is not made to Tenant, Tenant shall be entitled to share in any award made to Landlord, as long as Landlord first receives the fair market value of the real property upon which the Premises are located plus the unauthorized Premises Cost. Distribution of Award. All compensation and damages awarded for the taking of the land that constitutes a part of the Project or any portion thereof shall, except as otherwise herein provided, belong to and be the sole property of Landlord, and Tenant shall not have any claim or be entitled to any award for diminution in value of its leasehold or for the value of any unexpired Lease Term, provided however that the net amount of any award so received by Landlord (net of the cost of collection) shall constitute a credit against the Purchase Price calculated pursuant to Paragraph 34.4 hereof in the event of the exercise of either the Purchase Option or the Sales Option pursuant to Paragraph 34. All compensation and damages awarded for the taking of any Building or other Improvements, or any portion thereof, shall, except as otherwise herein provided, belong to and be the sole property of Tenant, and Landlord shall not have any claim or be entitled to any award for diminution in value of the land as a result thereof, as severance damages or otherwise. In addition, Tenant shall be entitled to any award specifically awarded by the agency to Tenant for Tenant's moving and relocation costs including the value of personal property and equipment of Tenant which cannot be relocated and Tenant's loss of good will. Notwithstanding the foregoing, in the event of any taking first occurring on or after September 1, 2003, then any compensation and damages awarded for the taking of any Building or other Improvements, or any portion thereof, net of the cost of collection of such award and the cost of repairing the Building or other Improvements, shall belong to and be the sole property of Landlord, provided however that the net amount of any award so received by Landlord (net of such costs of collection and repair) shall constitute a credit against the Purchase Price calculated pursuant to Paragraph 34.4 hereof in the event of the exercise of either the Purchase Option or the Sales Option pursuant to Paragraph 34.
Distribution of Award. The condemnation award shall belong to Landlord.
