6. The DISTRICT shall not request certifications that would require knowledge or services of the ARCHITECT beyond the scope of this AGREEMENT. The DISTRICT shall provide a topographical survey to the ARCHITECT upon requestfor the project.
6. The DISTRICT shall furnish the services of geotechnical engineers when such services are required and/or requested by the ARCHITECT. Such services may include, but are not limited to, test borings, test pits, determinations of soil bearing values, percolation tests, evaluations of hazardous materials, ground corrosion and resistivity tests, including necessary operations for anticipating subsoil conditions, with reports and appropriate professional recommendations.
7. DISTRICT shall make payment to the ARCHITECT of approved charges within forty- five (45) days of submission of ARCHITECT’s approved invoices for services completed to the date of the invoice. DISTRICT shall notify ARCHITECT within fourteen (14) days of submission of ARCHITECT’s invoices of any disputes over the invoice amount, and in no case shall DISTRICT delay releasing payment of any undisputed amounts. DISTRICT may retain 150% of the disputed amounts and the PARTIES shall endeavor to resolve such disputes in a mutually agreeable manner.
8. At DISTRICT’s discretion, DISTRICT may provide standards for security and/or a security consultant and ARCHITECT will incorporate into the PROJECT such standards and/or advice of the security consultant. A consultation and recommendation for school security systems to prevent acts of terrorism are not the responsibility of the ARCHITECT.

The DISTRICT shall provide a topographical survey to the ARCHITECT upon request, describing physical characteristics, legal limitations and utility locations for the site of the PROJECT, and a written legal description of the site. The surveys and legal information includes, grades and lines of the streets, alleys, adjacent drainage, rights of way, restrictions, easements, encroachments, zoning, deed restrictions, boundaries and contours of the site, locations, dimensions and necessary data pertaining to existing buildings, other improvements and trees, and information concerning available utility services and lines.
7. At ARCHITECT’s request, the DISTRICT shall provide ARCHITECT with the necessary documents regarding existing conditions and/or facilities as provided under Paragraph 25(g) of Article II.
8. At ARCHITECT’s request, the DISTRICT shall furnish the services of geotechnical engineers as required by authorities having jurisdiction over the PROJECT.
9. At ARCHITECT’s request, the DISTRICT shall furnish the services of other consultants not provided under this AGREEMENT when required.
10. At ARCHITECT’s request, the DISTRICT shall furnish the necessary tests, such as structural, mechanical, chemical, air and water pollution and hazardous material tests when required by law or authorities having jurisdiction over the PROJECT.
11. The DISTRICT shall provide all necessary testing and removal services for hazardous materials (including, but not limited to, asbestos and lead) in areas where the work of this AGREEMENT is to be conducted prior to the commencement of any construction activities in those areas. In the event that the DISTRICT determines that hazardous materials may remain in place with satisfactory encapsulation or must be removed by the Contractor, DISTRICT shall provide the ARCHITECT with written instructions on how encapsulation shall be accomplished or how demolition plans shall be prepared, and the ARCHITECT shall include those instructions or plans in the Construction Documents. DISTRICT shall hold harmless, indemnify and defend the ARCHITECT for any such claims arising as a result of ARCHITECT addressing hazardous materials on the PROJECT sites as identified by the DISTRICT. The DISTRICT requirement to hold harmless, indemnify and defend ARCHITECT shall not apply if ARCHITECT fails to properly incorporate any instructions, plans or other documents into the Construction Documents.

Districts Responsibilities. 5.1 The District, at no cost to XXXX, shall furnish the following information:

The scope of services for the Design Professional shall be provided to XXXX for its information. XXXX shall have no right to limit or restrict any changes of such services that are otherwise mutually acceptable to the District and Design Professional.
5.2.2 Supply, without charge, all necessary copies of programs, reports, drawings, and specifications reasonably required by XXXX except for those copies whose cost has been reimbursed by the District.
5.2.3 Provide XXXX with adequate information in its possession or control regarding the District’s requirements for the PROJECT, including information regarding the DISTRICT’s objectives, schedule, and budget constraints, as well as any other criteria provided by the DISTRICTProject.

4. The DISTRICT shall give prompt written notice to the ARCHITECT if the DISTRICT becomes aware of any fault or defect in the PROJECT or nonconformance with the Construction Documents. However, the DISTRICT’s failure or omission to do so shall not relieve the ARCHITECT of the ARCHITECT’s responsibilities under Title 21, Title 24, and the Field Act hereunder. Districts Responsibilities. 1. The DISTRICT shall provide to the ARCHITECT CONSULTANT information regarding requirements for the PROJECT, including information regarding the DISTRICT’s objectives, schedule, and budget constraints, as well as any other criteria provided by the DISTRICT.
2. Prior to the Schematic Design Phase, the ARCHITECT CONSULTANT shall prepare a current overall budget for the PROJECT which shall include the Construction Cost budget for the PROJECTPROJECT (“Budget”). The overall budget Budget shall be based upon the DISTRICT’s objectives, schedule, budget constraints, and any other criteria that are provided to the ARCHITECT CONSULTANT by the DISTRICT pursuant to Article IV, Section 1, above, and shall be consistent with EXHIBIT “E”. The DISTRICT shall approve the Construction Cost budget Budget prepared by the ARCHITECT CONSULTANT pursuant to this Section and this shall be the “Budget” Budget for the PROJECT as set forth in this AGREEMENT.
