DURATION OF THE MOA. The period of this MOA shall be from the date of execution through Sept. 30, 2019. This MOA shall renew automatically on Oct. 1 of each subsequent fiscal year until September 2023, unless terminated in writing by the Parties pursuant to the Termination Section of this MOA (see below). The Parties shall periodically review the requirements of this MOA and make amendments or modifications as needed (see below).

DURATION OF THE MOA. An MOA must, under the regulations, contain a provision that allows the MOA to be terminated or reconsidered if the project for which it was prepared has not been implemented within a specified period of time after execution of the MOA. The Iowa MOAs normally provide a period of up to five years after signatures for the stipulated measures to be completed. On a case-by-case basis, some MOAs may require completion in less time, such as three years.

DURATION OF THE MOA. The duration of this MOA shall be no more than five (5) years following the date of execution by the SHPO and Caltrans, or upon completion of the Undertaking, whichever comes first. If the terms are not satisfactorily fulfilled at that time, Caltrans shall consult with the signatories and concurring parties to extend it or to reconsider its terms. Reconsideration may include continuation of the MOA as originally executed, amendment of the MOA, or termination. In the event of termination, Caltrans will comply with Stipulations III through XI of the Section 106 PA if it determines that the Undertaking will proceed notwithstanding termination of this MOA.
