Common use of Duty Death Clause in Contracts

Duty Death. 21 A surviving spouse who becomes eligible to receive a pension under the provisions 22 of Section 36.05(5) of the ERS Act, on or after January 1, 2018, shall be entitled to 23 the benefits provided in subsection of 1.a. of this Article between January 1, 2018, 24 and December 31, 2019, so long as the surviving spouse continues to receive such 25 pension and is less than age 65.

Duty Death. 21 22 A surviving spouse who becomes eligible to receive a pension under the provisions 22 23 of Section 36.05(5) of the ERS Act, on or after January 1, 20182020, shall be entitled to 23 24 the benefits provided in subsection of 1.a. of this Article between January 1, 20182020, 24 25 and December 31, 20192022, so long as the surviving spouse continues to receive such 25 26 pension and is less than age 65.
