Common use of ECONOMIC HARDSHIP Clause in Contracts

ECONOMIC HARDSHIP. (a) The rate and maximum amount paid to a landowner or land operator under a cost−share agreement may be exceeded with written approval from the department if the landowner or land operator can demonstrate economic hardship as defined in s. NR 120.02 (19). Under the provision of economic hardship, the state cost−share rate may be increased by a maxi- mum of 15% above the standard percentage listed in Table 2 for all best management practices for which the landowner or land operator is eligible. (b) Under the provision of economic hardship, the following percentage payment rates will apply to the construction of manure storage facilities and barnyard runoff control systems:
