WAIVER IN CASE OF EMERGENCY. Section 47.1 In cases of emergency declared by the President of the United States, the Governor of the State of Ohio, the Federal or State Legislature, or the Sheriff, for such acts of God or civil disorder, the following conditions of the Agreement may be temporarily suspended by the Employer:
A. Time limits for the Employer’s and/or the employee’s filing of, or replies in grievances; and
B. All work rules and/or agreements and practices relating to the assignment of employees.
Section 47.2 Upon the termination of the emergency, should valid grievances exist, they shall be processed in accordance with the provisions outlined in the grievance procedure of this Agreement and shall proceed from the point in the grievance procedure to which they, the grievance(s), had properly progressed, prior to the emergency.
WAIVER IN CASE OF EMERGENCY. In cases of emergency declared by the President of the United States, the Governor of the state of Ohio, the Xxxxxxxxxx County Sheriff, the City Manager of Xxxxx Heights, or any other authorized governmental official, for acts of God or civil disorder, the following conditions of this Agreement may be temporarily suspended by the Employer
A. Time limits for the processing of grievances; and
B. Selected work rules and/or agreements and practices relating to the assignment of employees.
WAIVER IN CASE OF EMERGENCY. Section 6.1 In cases of emergency declared by the President of the United States, the Governor of the State of Ohio, the Superintendent of the CCBDD, or the Federal or State legislatures, the following conditions of this Agreement shall automatically be suspended:
A. time limits for the Employer or the Association replies on grievances; and
B. all work rules and/or assignments and practices relating to the assignment of employees.
Section 6.2 Upon termination of the emergency, should valid grievances exist, they shall be processed, in accordance with the provisions outlined in the grievance procedure, and shall proceed from the point in the grievance procedure to which they [the grievance(s)] had properly progressed.

Section 39.1 In cases of emergency declared by the President of the United States, the Governor of the State of Ohio, the State Legislature, the Xxxxxx County Sheriff, or the Chief, such as acts of God or civil disorder, the following conditions of this Agreement may be temporarily suspended by the Employer:
A. Time limits for the processing of grievances; and
B. All work rules and/or agreements and practices relating to the assignment of employees.
Section 39.2 Upon the termination of the emergency should valid grievances exist, they shall be processed in accordance with the provisions outlined in the grievance procedure of this Agreement and shall proceed from the point in the grievance procedure to which they, the grievance(s), had properly progressed, prior to the emergency.
WAIVER IN CASE OF EMERGENCY. Section 1. In cases of emergency declared by the President of the United States, the Governor of the State of Ohio, the Board of County Commissioners, the federal or state legislature, or the Sheriff, such as acts of God or civil disorder, the following conditions of this agreement may automatically be suspended at the discretion of the Employer:

In cases of emergency declared by the President of the United States, the Governor of the State of Ohio, the Washington County Sheriff, or the Federal or State Legislature, such as acts of God or civil disorder, the following conditions of this Agreement may be temporarily suspended by the Employer:
A. Time limits for Management’s replies on grievances; and
B. All work rules and/or agreements and practices relating to the assignment of employees.
Section 30.2. Upon the termination of the emergency, should prior grievances exist, they shall be processed in accordance with the provisions outlined in the grievance procedure of this Agreement and shall proceed from the point in the grievance procedure to which they (the grievance(s)) had properly progressed, prior to the emergency.
WAIVER IN CASE OF EMERGENCY. Section 34.1 In cases of emergency declared by the President of the United States, the Governor of the State of Ohio, the Board of Richland County Commissioners, the Richland County Engineer, the Federal or State Legislature, such as acts of God or civil disorder, the following conditions of this Agreement shall automatically be suspended:
A. time limits for Management or the Union’s replies on grievances; and,
B. all work rules and/or agreements and practices relating to the assignment of all county employees.
Section 34.2 Upon the termination of the emergency, should valid grievances exist, they shall be processed in accordance with the provisions outlined in the grievance procedure of this Agreement and shall proceed from the point in the grievance procedure to which they (the grievances) had properly progressed.
WAIVER IN CASE OF EMERGENCY. Section 35.1. In cases of emergency declared by the President of the United States the Governor of the State of Ohio, the Sheriff or Federal or State Legislature or the President of the University, such as acts of God or civil disorder, the following conditions of this Agreement may be temporarily suspended by the Employer:
A. Time limits for the processing of grievances; and
B. All work rules and/or agreements and practices relating to the assignment of employees.
Section 35.2. Upon the termination of the emergency should valid grievances exist, they shall be processed in accordance with the provisions outlined in the grievance procedure of this Agreement and shall proceed from the point in the grievance procedure to which they, the grievance(s), had properly progressed, prior to the emergency.
Section 35.3. For the purposes of this entire Contract, emergency shall have the following meaning. An emergency shall mean a natural disaster, civil unrest, shut down of the University, or any similar action in addition to the provisions listed in Section 35.1. An emergency shall not include employees calling in sick, on vacation, compensatory time, etc., employees on approved leaves of absence, scheduling of events or special event details. These are foreseen every day occurrences in Police work and should not mandate the deployment of officers.
WAIVER IN CASE OF EMERGENCY. Section 1. In cases of emergency declared by the President of the United States, the Governor of the State of Ohio, the Board of Lorain County Commissioners, the federal or state legislature, City Council, or the Mayor, such as acts of God or civil disorder, the following conditions of this agreement may automatically be suspended at the discretion of the Employer:
1. Time limits for management replies on grievances, or Union submissions of grievances.
2. Any or all agreements and practices relating to the assignment of employees; except that it is agreed that there shall be no loss of premium pay earned as set forth in this agreement, unless otherwise mutually agreed upon between the parties.
Section 2. Upon the termination of the emergency, should valid grievances exist, they shall be processed in accordance with the provisions outlined in the grievance procedure and shall proceed from the applicable point in the grievance procedure to which they had properly progressed.
WAIVER IN CASE OF EMERGENCY. Section 28.1 In cases of emergency declared by the President of the United States, the Governor of the State of Ohio, the Board of Lorain County Commissioners, the Federal or State Legislature, the Police Chief, City Administrator, or Oberlin City Council, such as acts of God or civil disorder, the following conditions of this Agreement may automatically be suspended at the discretion of the Employer:
(1) Time limits for management replies on grievances, or OPBA submissions of grievances.
(2) Selected work rules and/or agreement and practices relating to the assignment of all employees.
(3) The privilege of leaving work to perform OPBA representation in accordance with the terms of Article VII of this Agreement.
Section 28.2 Upon the termination of the emergency, should valid grievances exist, they shall be processed in accordance with the provisions outlined in the Grievance Procedure and shall proceed from the applicable point in the Grievance Procedure to which they had properly progressed.
