Common use of Educational Fund Clause in Contracts

Educational Fund. 18.01 The parties to this Agreement do hereby agree to maintain an Educational Trust Fund to be administered by a Board of six (6) Trustees; three (3) appointed by the Employers and three (3) appointed by the International Union of Elevator Constructors. The Educational Trust Fund shall be known as the "Canadian Elevator Industry Educational Program" and shall provide a program for educating and training Elevator Constructor Mechanics and Helpers. 18.02 The Board of Trustees shall have full authority and discretion to adopt an Agreement and Declaration of Trust and an educational and training program which shall become part of this Agreement and binding on all parties signatory to this Agreement. 18.03 The "Canadian Elevator Industry Educational Program" shall be financed by contributions by the Employers and the Elevator Constructor Mechanics and Helpers. The Employer agrees to pay and contribute the applicable hourly contribution for each hour of work performed by all Elevator Constructor Mechanics and Helpers in his employ, in accordance with the Contribution Schedule contained herein and in accordance with the terms of the Declaration of Trust adopted by the Board of Trustees. Each Elevator Constructor Mechanic and Helper shall continue to pay and contribute twenty two and a half cents ($.225) per hour. Educational Fund - Employer Contribution - Amount Per Hour $0.31 18.04 All contributions required by this Article shall be remitted by the Employer at the office of the Administrator effective at time of signing. These amounts are over and above any wage settlement and are not to be deducted from any monetary package. The cutoff dates for each month shall be the week endings as advised by the Administrator. 18.05 Notwithstanding the above contribution amounts, should the Education Fund require additional contributions, the Employer contribution will increase $0.05 per hour worked and the Employee contribution will increase $0.05 per hour worked.

Effective December 1, 2007,the contribution rate is ten cents ($.10) per hour (As per Article 18.05) Educational Fund - Employer Contribution - Amount Per Hour $0.310.135 18.04 All contributions required by this Article shall be remitted by the Employer at the office of the Administrator effective at time of signing. Educational Fund - Employer Contribution - Amount Per Hour will be forty-one cents ($0.310.41). 18.04 All contributions required by this Article shall be remitted by the Employer at the office of the Administrator effective at time of signing. These amounts are over and above any wage settlement and are not to be deducted from any monetary package. The cutoff cut-off dates for each month shall be the week endings as advised by the Administrator. 18.05 Notwithstanding the above contribution amounts, should the Education Fund require additional contributions, the Employer contribution will increase $0.05 per hour worked and the Employee contribution will increase $0.05 per hour worked.

The Educational Trust Fund Joint Apprentice Committee shall be known as the "Canadian Elevator Industry Educational Program" and shall provide responsible for providing a program for educating and training Elevator Constructor Mechanics Journeymen and Helpers. 18.02 The Board of Trustees shall have full authority and discretion to adopt an Agreement and Declaration of Trust and an educational and training program which shall become part of this Agreement and binding on all parties signatory to this Agreement. 18.03 The "Canadian Apprentices in the local Union area in conjunction with the National Elevator Industry Educational Program" . Such program shall be under the sole and exclusive direction of the Joint Apprentice Committee. The National Elevator Industry Education Program shall be financed by contributions by Companies as provided. Upon the Employers and effective date of this Agreement, the Elevator Constructor Mechanics and Helpers. The Employer Company agrees to pay and contribute the applicable hourly contribution to such Fund twenty four cents ($.24) per hour for each hour of work performed by all Elevator Constructor Mechanics Journeymen, JIT’s and Helpers in his employApprentices. The twenty four cents ($.24) hourly contribution shall increase annually. The thirteen cents ($.13) Company contribution effective March 17, in accordance with 2005 will not be deducted from the Contribution Schedule contained herein hourly wage and fringe package of the elevator constructor. Any future increase to the thirteen cents ($.13) to the Company contribution is their sole responsibility. The existing twenty-four cents ($.24) contribution plus the additional thirteen cents ($.13) will become the base thirty seven cents ($.37) hourly contribution and shall increase annually. The amount of the Company contribution and will be as follows: 3/17/05 $0.03 $0.37 3/17/06 $0.03 $0.40 3/17/07 $0.03 $0.43 3/17/08 $0.03 $0.46 Payment of said contributions shall be in accordance with the terms of the Declaration of Trust adopted by the Board of Trustees. Each Elevator Constructor Mechanic and Helper However, in no event shall continue contributions by the Company exceed the lowest contribution paid by any Company contributor to pay and contribute twenty two and a half cents ($.225) per hourthe Fund. Educational Fund - Employer Contribution - Amount Per Hour $0.31 18.04 All No contributions required by this Article shall be remitted made during the six (6) months probationary period on behalf of probationary employees unless otherwise provided by the Employer at NEIEP Trustees. If the office Companies are required for any reason to increase the Companies’ contribution to the National Elevator Industry Educational Program, then the amount of such additional Company contribution shall serve to reduce the Administrator effective at time wage rate set forth in Section VII (B) of signing. These amounts are over this Agreement in an amount adjusted to reflect such increased Company contribution and above any its effect upon the wage settlement and are not to be deducted from any monetary package. The cutoff dates for each month shall be the week endings as advised by the Administratorrate. 18.05 Notwithstanding the above contribution amounts, should the Education Fund require additional contributions, the Employer contribution will increase $0.05 per hour worked and the Employee contribution will increase $0.05 per hour worked.

If the above Employers are required for any reason to increase the Employer’s contribution amountsto the National Elevator Industry Educational Program, should then the Education Fund require amount of such additional contributions, the Employer contribution will increase $0.05 per hour worked shall serve to reduce the effective wage rate set forth in Section VII (B) of this Agreement in an amount adjusted to reflect such increased Employer contribution and its effect upon the Employee contribution will increase $0.05 per hour workedwage rate.

Such Fund has been established pursuant to and in compliance with the pro- visions of Section 302 of the Labor-Manage- ment Relations Act, as amended. 18.02 2. The Board of Trustees of the Education Trust Fund shall have full authority and discretion dis- cretion to adopt an Agreement and Declaration Declara- tion of Trust and an educational and training program which shall become part of this Agreement and binding on all parties signatory to this Agreement.this 18.03 3. The "Canadian National Elevator Industry Educational Program" Educa- tion Program shall be financed by contributions contribu- tions by Employers as provided in the Employers Dec- laration of Trust and the Elevator Constructor Mechanics and Helpersvarious collective bargaining agreements, including this Agreement, which obligate the Company to make such contributions. The Employer Upon the effective date of this Agreement the Company agrees to continue to pay and contribute the applicable hourly contribution to such Fund $.085 per hour for each hour of work performed by all Elevator Constructor Me- chanics and Helpers. The eight and one-half cents (8-1/2¢) hourly contribution shall in- crease upon every anniversary of the last wage rate change of each Local Union, in ac- cordance with the following: Hourly Effective Date Amount of Increase Contribution Rate 4. It is understood and agreed that if prior to any calendar year the Trustees shall advise the IUEC and Xxxx that the amount of the contributions set forth in Par. 3. above are providing more than sufficient funds to finance and maintain the existing education program, then the IUEC and Xxxx shall meet to discuss and agree upon whether the amount of the Company’s con- tributions to the Education Plan should be reduced and the wage rate of Elevator Con- structor Mechanics and Helpers in his employ, in accordance with the Contribution Schedule contained herein and in accordance with the terms of the Declaration of Trust adopted increased by the Board amount of Trustees.
