Environmental, Health & Safety. SECTION 1. The Company will recognize a total of three Union safety representatives, two for the Engineering Building areas and one for the Test areas, for the purpose of discussion and consultation with designated management representatives regarding safety problems. The Union shall designate one of the representatives as the Union safety chairman. The safety chairman will be an active member of the Environmental, Health and Safety Council and will be paid for attending such meetings. Union safety representatives shall be active employees of the Company. No employee shall act as a Union safety representative unless at the time of his selection he has not less than twelve (12) months' seniority as defined in Article VIII. SECTION 2. Each Union safety representative shall, after notice to and permission from the department supervisor, be allowed to leave his job when necessary to attend meetings with the Company representative(s). Any problems unresolved at these meetings may be taken up by the Union safety chairman for discussion at the next regularly scheduled meeting of the committee of management. SECTION 3. The Company will hold meetings as mutually agreed upon between representative(s) of the safety department and the Union safety chairman, with optional attendance by other Union safety representatives. (a) An employee who discovers a Health & Safety issue in his immediate work area which he reasonably believes has the potential of causing serious physical harm or injury shall take it up with his department supervisor. If the issue is not resolved, the employee may then take it up with the Union safety representative for the area, providing one is available. Under normal conditions and subject to the availability of the Union safety representative, the request will be honored as soon as practicable, but no later than the end of the shift. The Union safety representative, in turn, will take the matter up with the Company's safety representative. (b) The Company will inform the Union safety chairman or safety representative of any serious accident which involves an employee covered under this agreement. The Union safety chairman or a safety representative may review all accident reports involving employees covered under this agreement and will, upon request, be given a copy of such accident reports. Environmental, Health & Safety. Gland represents, warrants and certifies that it complies with all environmental health and safety laws applicable to Gland’s manufacture and sale of the Product and has determined that it is in compliance with such laws, and, subject to Article 8, Gland agrees to indemnify Sagent in the event that Gland does not comply with any such laws, and such non-compliance results in any liability to any third party by Sagent.
Environmental, Health & Safety. 20.01 In order to maintain proper standards for safety and to eliminate, as far as possible, industrial accidents and sickness, the Company shall maintain and keep current workable rules and regulations for the prevention of accidents and industrial illness and the establishment of proper plant hygiene. The plant and safety rules shall be published and such rules shall be the official safety rules of the plant. The Company shall make provisions for the safety and health of its employees at the plant during the hours of their employment and provide protective devices and other equipment it deems necessary to protect employees properly from injury or disease, and the Union may from time to time bring to the attention of the Company recommendations or complaints under this Section. 20.02 The Company agrees to provide adequate safety devices where it deems necessary. Whenever such devices are furnished by the Company, it shall be mandatory for employees to use them. 20.03 Any employee sent home by the Company due to injury or sickness caused or aggravated in the course of his employment in the plant, shall receive wages at the Employee’s appropriate hourly base rate for the balance of the shift. It is understood and agreed that the foregoing applies to industrial injury and sickness only, and shall not hinder or make void the Ontario Workplace Safety and Insurance Act, 1997. 20.04 The Company recognizes the Union's interest in matters pertaining to safety and health. Therefore, the Company’s Joint Environmental Health and Safety Committee shall include a total of three (3) union representatives: one (1) certified worker representative and two (2) other bargaining unit members. Upon being elected or appointed to the Company’s Joint Health and Safety Committee, the bargaining unit member will be recognized as a member of such committee. The Committee member shall remain on the shift they were elected or appointed to for the duration of their term unless the Committee member chooses otherwise. 20.05 Members of the Company’s Joint Environmental Health & Safety and Environment Committee shall not suffer any loss of pay or benefits for time spent in the performance of their duties during regular working hours.
Environmental, Health & Safety. The Managing Member shall or shall cause the Operator and the Administrator to (without duplication) promptly notify the Members in writing of any notice of violations or noncompliance issued by Governmental Authorities, any pending administrative or judicial proceeding, any third party lawsuit, any known material release of hazardous substances as defined under Applicable Laws, or any claim or violation identified by the Managing Member, to the extent any such notice, proceeding, lawsuit, release, claim or violation relate to compliance by the Company or any Project Company with Applicable Laws and could reasonably be expected to result in a fine, penalty, loss or damage to the Company or any Project Company of $25,000 or more. The Managing Member shall ensure that the Operator and the Administrator comply with the various reporting requirements set forth in the O&M Agreements and the Management Services Agreements, respectively, and shall provide a copy of such reports to the Members promptly upon receipt.

The Company and Union are committed to achieving world class safety performance through cooperation and support of processes/activities that reduce injuries. The parties agree to utilize the existing joint committee to manage the Safety Culture Change process. This joint committee consists of, and will continue to consist of, Company business leaders, EH&S managers/coordinators, and Union Representatives. This joint committee will be co-chaired by the Local Lodge 743 President and the Company Site Safety Executive or designee with equal authority. This joint committee will meet at a minimum on a monthly basis. In addition, the parties agree to continue working together to maintain certification through OSHA’s Voluntary Protection Program (VPP). Section 2. The Company will recognize a total of fifteen (15) Union Safety Representatives for the purpose of discussion and consultation with a designated management representative regarding any environmental, health and safety problems. Activities for Union Safety Representatives shall include RIDII Program, recordable accident investigations, cross- department audits, and inspections. Activities for Union Safety Representatives may include non-recordable accident investigations, training, observing safety behaviors, ergonomic assessments and job safety hazard analysis. Additional activities may be assigned by mutual agreement. One (1) of the fifteen (15) representatives shall be recognized as Chief Union Safety Representative for all areas and shifts. Union Safety (1) of the business units/operating centers they service. It is the intent of the parties to have at least one (1) Union Safety Representative on each first and second shift actively employed in the operating centers and business units referenced above which are: Worldwide Customer Support, Electronic Operations, Space Systems, Mechanical Engine Systems, Manufacturing Support, and Air Management Systems. One (1) additional Union Safety Representative will be recognized to represent the third shift when the population of the third shift exceeds one hundred and twenty five (125) employees and that population is sustained for greater than ninety (90) days. Two (2) additional Union Safety Representatives will be assigned at large by the Local Lodge President and Chief Union Safety Representative with assignments to be mutually agreed upon between the Company and the Union. Environmental, Health & Safety. (a) The total number of Union EHS Representatives shall be determined by applying a formula of one (1) Union EHS Representative for every one hundred and forty (140) employees in the bargaining unit by site, as set forth in Article 2. The number of Union EHS Representatives assigned to any site shall not exceed a ratio of one (1) Union EHS Representative for each one hundred and twenty (120) bargaining unit employees at that site, subject to the overall limitation of one Union EHS Representative per one hundred and forty (140) employees set forth above. Local Lodge 700 may have twelve (12) EHS Representatives plus one Chief EHS Representative. Local Lodge 1746 may have fifteen (15) EHS Representatives plus one Chief EHS Representative. (b) Should the number of Union EHS Representatives exceed the limitation set forth in Paragraph above, the Company shall so inform the Union in writing. The Union shall thereupon promptly notify the Company, in writing, of the revisions in Union EHS Representative assignments required by such limitation. Failure of the Union to so notify the Company within ten (10) days (excluding Saturdays, Sundays and holidays) shall automatically reduce the number of Union EHS Representatives to the required level by canceling Union EHS Representative appointments on the basis of seniority as defined in Article 8, starting with the least senior Union EHS Representative. However, if the requirement to reduce the number of Union EHS Representatives is caused by a reduction in the workforce, the Company agrees the affected Union EHS Representatives will remain in their position for the duration of their appointment. (c) The Union will notify the Company of the assignments and shifts of the Union EHS Representatives and, upon request of the Company, will discuss these assignments and shifts to ensure coverage for all shifts and areas. Environmental, Health & Safety. 16.1 The Parties acknowledge and agree that Producer remains solely responsible for all environmental, health and safety requirements and obligations regarding the use, handling, storage, transportation, recycling, processing, Release and disposal of all raw materials, Product (prior to the time title and risk of loss transfers to Customer in accordance with Clause 5.3 (Title and Title Transfer; Point of Delivery)), by-products, residuals, derivatives and wastes of any kind at the Texas City Styrene Plant. 16.2 Customer acknowledges that Product may be, or become, considered a Hazardous Material under various applicable Laws and that it is familiar with any hazards of Product and its applications and the containers in which Product is shipped. 16.3 Customer agrees to disseminate to third parties (including employees and customers), as required by applicable Law, Material Safety Data Sheets consistent with applicable Laws, including the Occupational Safety and Health Administration’s Hazard Communications Standard.
