Effect of Void Provision. If the Company or I successfully assert that any provision in this Agreement is void, the rest of the Agreement shall remain valid and enforceable unless the other party to this Agreement elects to cancel it. If this Agreement is cancelled, I will repay the consideration I received for signing it.
Effect of Void Provision. If a Party successfully asserts that any provision in this Agreement is void or invalid, the rest of the Agreement shall remain valid and enforceable unless the other Party elects to cancel it. If this Agreement is cancelled pursuant to the preceding sentence, then Executive shall forfeit and/or repay any additional amounts which Executive received in exchange for signing it.
Effect of Void Provision. If the Company or the Executive successfully asserts that any provision in this Agreement is void, the rest of the Agreement will remain valid and enforceable unless the other party to this Agreement elects to cancel it; provided, however, that if the Company asks the Executive to sign a new document containing a legal and enforceable replacement provision in lieu of canceling the Agreement, the Executive promises that the Executive will do so. If this Agreement is canceled, the Executive will repay any payments or benefits the Executive received for signing it.

If the Company or the Employee successfully asserts that any provision in this Agreement is void, the rest of the Agreement will remain valid and enforceable unless the other party to this Agreement elects to cancel it; provided, however, that if the Company asks the Employee to sign a new document containing a legal and enforceable replacement provision in lieu of canceling the Agreement, the Employee promises that the Employee will do so. If this Agreement is canceled, the Employee will repay any payments or benefits the Employee received for signing it.
Effect of Void Provision. If Aegis or the Employee asserts that any provision in this Agreement is void, and there is a final determination by the Arbitrator(s) declaring the challenged provision void, the rest of the Agreement shall remain valid and enforceable unless the other party to this Agreement immediately elects to cancel it. If this Agreement is so cancelled, the parties hereto will each return all consideration received for signing this Agreement to the other party; the Agreement shall be deemed a nullity; and all claims and other rights released by this Agreement shall automatically return to the releasing party. All statutes of limitation regarding any such claims shall be deemed tolled, and any laches or other equitable defenses based on the passage of time shall be deemed waived, all for the express purpose of returning the parties to the positions that that they were in immediately prior to the execution of this Agreement.
Effect of Void Provision. If a Party successfully asserts that any provision in this Agreement is void or invalid, the rest of the Agreement shall remain valid and enforceable. Executive hereby agrees that if any portion of Executive’s release of claims set forth in Section 5 is deemed invalid, Executive shall enter into a new agreement with the Company that contains a release of claims that is satisfactory to the Company and to Executive.

If this Agreement is cancelled or terminated earlier than the anticipated end of the Continued Employment Period and/or Consulting Period, as provided herein, I will repay and return the consideration I received for signing it, including any right to equity vested during the Continued Employment Period and/or the Consulting Period.
Effect of Void Provision. If any term or provision of this Release, or the application thereof to any person or circumstances will to any extent be invalid or unenforceable, the remainder of this Release, or the application of such terms to persons or circumstances other than those as to which it is invalid or unenforceable, will not be affected thereby, and each term of this Release will be valid and enforceable to the fullest extent permitted by law; provided, however, if in response to a claim by Employee any court or arbitrator were to find that the release of claims set forth herein is unlawful or unenforceable, or was not entered into knowingly and voluntarily, Employee agrees, at the Company’s option, either to return to the Company the consideration provided in paragraph 1 hereof (unless such repayment is prohibited by law) or to execute a release in a form satisfactory to the Company that is lawful and enforceable.
Effect of Void Provision. Should any provisions of this Agreement be declared illegal or unenforceable by any court of competent jurisdiction and cannot be modified to become legal and enforceable, such provision will immediately become null and void, leaving the remainder of this Agreement valid and enforceable, in full force and effect, unless the other party to this Agreement elects to cancel it.
