Effective Final Settlement Date. The effective date of this Settlement will be when the final approval of the settlement can no longer be appealed, or, if there are no objectors and no plaintiffs in intervention at the time the court grants final approval of the settlement, the date the court enters judgment granting final approval of the settlement.

Effective Final Settlement Date. The effective date of this Settlement will be when the Defendant fully funds the Gross Settlement Amount.
Effective Final Settlement Date. “Effective Final Settlement Date” shall mean the date this Agreement is approved as provided herein and the Court’s order granting Final Approval and entry of Judgment becomes final and is no longer appealable. For purposes of this Agreement, “becomes final and is no longer appealable” shall mean the later of: (a) the day after the last date by which a notice of appeal to the applicable Court of Appeal of the order and judgment approving this Agreement may be timely filed and none is filed (i.e., 61 days from notice of entry of judgment); (b) if an appeal is filed, and the appeal is finally disposed of by ruling, dismissal, denial, or in any other manner that confirms the validity of the order and judgment, the day after the last date for filing a request for further review of the order and judgment approving this Agreement passes, and no further review is requested; or (c) if an appeal is filed and the order approving this Agreement is affirmed and further review of the order is requested, the day after the review is finally resolved and the order and judgment approving this Agreement is affirmed.

Effective Final Settlement Date. The date by which this Joint Stipulation and Settlement Agreement is finally approved as provided herein and the Court’s Judgment becomes binding. For purposes of this Settlement, the Judgment becomes final upon the later of: (i) sixty-two (62) calendar days after entry of Judgment, and no appeal is filed within that period; (ii) if an appeal is filed, the date the Judgment is affirmed on appeal, the date of dismissal of such appeal, or the expiration of the time to file a petition for writ of certiorari, or, (iii) if a petition for writ of certiorari is filed, the date of denial of the petition for a writ of certiorari, or the date the Judgment is affirmed pursuant to such petition.

Effective Final Settlement Date. Effective Date” of the Settlement means the date on which the Court’s order granting Final Approval of this Joint Stipulation becomes final. Such order becomes final upon the following events:
Effective Final Settlement Date. The Effective Final Settlement Date shall be either: (i) in the event that the Settlement has received Final Approval by the Court, and regardless of whether any timely objections thereto have been filed or withdrawn, then sixty-five (65) calendar days after the Court’s issuance of the Final Approval Order without a timely appeal being filed; or, (ii) in the event that a timely appeal of the Court’s Final Approval Order has been filed, then the Settlement Agreement shall be final when the applicable appellate court has rendered a final decision or opinion affirming the Court’s Final Approval Order without material modification, and the applicable date for seeking further appellate review has passed without further appellate review being sought.
Effective Final Settlement Date. The effective date of this Settlement will be when all of the following events have occurred: 1. the Joint Stipulation of Class Action Settlement and Release has been executed by all Parties, Class Counsel, and ITS’s Counsel; 2. the Court has given preliminary approval to the Settlement; 3. the Class Notice has been sent to the Class Members, providing them with an opportunity to object to the terms of the Settlement or to opt-out of the Settlement; 4. the Court has held a Final Approval Hearing and entered a Final Approval Order and Judgment certifying the Class, dismissing the Action with prejudice, and approving of the Settlement; 5. sixty-five (65) calendar days have passed since the Court has entered a Final Approval Order and Judgment certifying the Class, dismissing the Action with prejudice, and approving of the Settlement; and 0. xx the event there are written objections filed prior to the Final Approval Hearing that are not later withdrawn or denied, the later of the following events: five (5) business days after the period for filing any appeal, writ, or other appellate proceeding opposing the Court’s Final Approval Order and Judgment approving the Settlement has elapsed without any appeal, writ, or other appellate proceeding having been filed; or, if any appeal, writ, or other appellate proceeding opposing the Court’s Final Approval Order and Judgement approving the Settlement has been filed, five (5) business days after any appeal, writ, or other appellate proceedings opposing the Settlement has been finally and conclusively dismissed with no right to pursue further remedies or relief.
