Effective Final Settlement Date. The effective date of this Settlement will be when the final approval of the settlement can no longer be appealed, or, if there are no objectors and no plaintiffs in intervention at the time the court grants final approval of the settlement, the date the court enters judgment granting final approval of the settlement.
Effective Final Settlement Date. The effective date of this Settlement will be when the Defendant fully fund the Gross Settlement Amount.
Effective Final Settlement Date. “Effective Final Settlement Date” shall mean the date this Agreement is approved as provided herein and the Court’s order granting Final Approval and entry of Judgment becomes final and is no longer appealable. For purposes of this Agreement, “becomes final and is no longer appealable” shall mean the later of: (a) the day after the last date by which a notice of appeal to the applicable Court of Appeal of the order and judgment approving this Agreement may be timely filed and none is filed (i.e., 61 days from notice of entry of judgment); (b) if an appeal is filed, and the appeal is finally disposed of by ruling, dismissal, denial, or in any other manner that confirms the validity of the order and judgment, the day after the last date for filing a request for further review of the order and judgment approving this Agreement passes, and no further review is requested; or (c) if an appeal is filed and the order approving this Agreement is affirmed and further review of the order is requested, the day after the review is finally resolved and the order and judgment approving this Agreement is affirmed.
Effective Final Settlement Date. The later of the following: (i) if no objections to the Settlement have been filed, or timely objections have been filed and then withdrawn, then the date the Court enters judgment granting Final Approval;
Effective Final Settlement Date. The effective date of this Settlement or Final Settlement Date shall be: (1) if no Class Members intervene and there are no objections, the date the Court enters the Final Approval Order and Final Judgment; (2) the date of final affirmation of the Final Approval from any appeal, the expiration of the time for, or the denial of, a petition to review the Final Approval, or if review is granted, the date of final affirmation of the Final Approval following review pursuant to that grant; or (3) the date of final dismissal of any appeal from the Final Approval or the final dismissal of any proceeding to review the Final Approval, provided that the Final Approval is affirmed and/or not reversed in any part; or (4) if no Class Members intervene but objections are filed, the expiration date of the time for the filing or noticing of any appeal from the Court’s Final Approval of the Settlement, as determined under Rule 8.104(a)(3) of the California Rules of Court.
Effective Final Settlement Date. The effective date of this Settlement or Final Settlement Date shall be the earlier of the following dates: (1) the date of final affirmation of the Final Approval from any appeal, the expiration of the time for, or the denial of, a petition to review the Final Approval, or if review is granted, the date of final affirmation of the Final Approval following review pursuant to that grant; or (2) the date of final dismissal of any appeal from the Final Approval or the final dismissal of any proceeding to review the Final Approval, provided that the Final Approval is affirmed and/or not reversed in any part; or (3) if no class members intervene but objections are filed, the expiration date of the time for the filing or noticing of any appeal from the Court’s Final Approval of the Settlement, as determined under Rule 8.104(a)(3) of the California Rules of Court or (4) if no class members intervene and there are no objections, the date the Court enters the Final Approval Order and Final Judgment.
Effective Final Settlement Date. The Effective Final Settlement Date shall be either: (i) in the event that the Settlement has received Final Approval by the Court, and regardless of whether any timely objections thereto have been filed or withdrawn, then sixty-five (65) calendar days after the Court’s issuance of the Final Approval Order without a timely appeal being filed; or, (ii) in the event that a timely appeal of the Court’s Final Approval Order has been filed, then the Settlement Agreement shall be final when the applicable appellate court has rendered a final decision or opinion affirming the Court’s Final Approval Order without material modification, and the applicable date for seeking further appellate review has passed without further appellate review being sought.
Effective Final Settlement Date. Shall be the date when all of the following events have occurred: (a) this Stipulation has been executed by all Parties and Class Counsel and Defendant’s Counsel; (b) the Court has given preliminary approval to the Settlement; (c) Class Notice has been given to Class Members providing them an opportunity to exclude themselves from the Settlement; (d) the Court has held a Final Approval Hearing and entered a final order approving this Stipulation; and (e) the time for appeal, if applicable, has expired. If no objection was made to the Settlement, there is no right to appeal and the Effective Date is the date the Court signs the final order and judgment. If an objection has been filed, the Effective Date means: (i) the date of final affirmation of the Final Approval Hearing, the expiration of the time for, or the denial of, a petition to review, or if review is granted, the date of final affirmation of the Final Approval Hearing following review pursuant to the grant; or (ii) the date of final dismissal of any appeal from the Final Approval Hearing or the final dismissal of any proceeding to review the Final Approval Hearing, provided the final affirmation of the Final Approval Hearing is affirmed and not reversed in any part; or (iii) if no appeal is filed, the expiration date of the time for the filing or noticing of any appeal from the Court’s final affirmation of the Final Approval Hearing.
Effective Final Settlement Date. “Effective Date” and “Final” mean (1) in the event that the Settlement has received Final Approval by the Court and there were no timely objections filed, then the date of entry of the final approval order and final judgment; or, (2) in the event that one or more timely objections has/have been filed and not withdrawn and a motion to intervene and/or motion to vacate judgment has been filed, then upon the passage of the applicable date for an objector to seek appellate review of the Court’s order of final approval of the Settlement, without a timely appeal having been filed; or, (3) in the event that a timely appeal of the Court’s order of final approval has been filed, then the Settlement Agreement shall be final when the applicable appellate court has rendered a final decision or opinion affirming the Court’s final approval without material modification, and the applicable date for seeking further appellate review has passed.
Effective Final Settlement Date. The Effective Final Settlement Date shall be: the date of Defendant’s fulfillment of its payment obligations under Section III (J)(9) below.
