Time to File. The parties agree that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website, its Services, or this Agreement must be filed within one (1) year after such claim or cause of action or arose, or else be forever barred.
Time to File. A grievance is one specific action which is described in Section 2. In order to avoid stale litigation, a grievance must be filed within 15 calendar days of the date of the specific action which is the subject of the grievance. If the grievant was prevented from filing the grievance during the 15 calendar day period because of an Agency failure to perform a duty owed to the grievant or because of any concealment by the Agency that prevented discovery of the action during the 15-day period, then the grievance must be filed within 15 calendar days of the grievant’s discovery of the action. A step of the grievance procedure can be waived with the consent of both parties.
Time to File. Any and all actions, rights, claims, costs, losses, and damages by any Party against any other Party arising out of this Agreement or the performance of this Agreement shall be barred one year after installation of any Equipment or performance of any Service that is the subject of such action, right, claim, cost, loss, or damage.
Time to File. The defendant must move to arrest judgment within 14 days after the court accepts a verdict or finding of guilty, or after a plea of guilty or nolo contendere.
Time to File. Any grievance for which redress is not specifically defined in the Faculty By-Laws or in Articles VIII or XV hereof shall be subject to redress through the procedures outlined below, Steps 1 through 3, and in Exhibit H. Prior to initiating Steps 1 through 3, the grievant shall inform the Xxxx of the Faculty or designee of the grievance. The grievance must be submitted in writing within ten (10) University calendar days after the occurrence giving rise thereto, or within ten (10) University calendar days of the date on which the grievant has learned or should have learned of such occurrence, whichever is later.
(a) Step 1. In the event there is no resolution of the grievance within thirty (30) days after the grievant has informed the Xxxx of the Faculty or designee of the grievance, the grievant or the Union shall submit his grievance to the Xxxxxxx/Vice President of Academic Affairs. The Xxxxxxx/Vice President for Academic Affairs or his designee shall investigate the matter in such a manner as s/he shall deem appropriate and shall submit a written report to the grievant and the Union, within ten (10) Calendar Days of the date on which s/he received the written grievance.
(b) Step 2. If the grievance is not suitably resolved in Step 1, the grievant or the Union may, within five (5) Calendar Days after receipt of the written decision from the Xxxxxxx/Vice President of Academic Affairs or designee, submit a written appeal to the President. The President shall have ten (10) Calendar Days following the receipt of such written appeal to submit a written response to the grievant, the Union, and the Xxxxxxx/Vice President of Academic Affairs. It is agreed that in all cases of dismissal the Faculty Member and the Union may go immediately to Step 2 of this grievance procedure. It is further agreed that each party to this Agreement may submit a grievance to the other party, and, by mutual agreement, proceed immediately to Step 2.
(c) Step 3. If the grievance is not suitably resolved in Step 2, the Union, but not a Unit Member, may within thirty (30) Calendar Days of the receipt of the written response in Step 2, notify the President of its intent to submit the grievance to binding arbitration. The parties shall have the right to mutually agree upon the arbitrator, but in the event they cannot so agree within fifteen (15) Calendar Days of receipt of the above notice, the matter shall, forthwith, be submitted to the Pennsylvania Bureau of Mediation (PBM) and the PBM s...
Time to File. All grievances must be presented in accordance with this Article and no later than 30 calendar days from the date the grievant first became aware of, or should have become aware of with the exercise of reasonable diligence, the alleged violation of the Agreement.
1) The failure of an employee to file a grievance within the 30 day period does not provide an opportunity for the Association to later file a grievance by invoking a new 30 day time limit.
2) Grievances not presented within this 30 calendar day period shall be considered untimely and ineligible for processing through the Grievance Procedure.
Time to File. A grievant or the Union shall file a grievance in writing within forty-five (45) work days after the occurrence of the event giving rise to the alleged violation, or within forty-five (45) work days from the time the grievant or the Union should reasonably have become aware of the occurrence of the event giving rise to the alleged violation, whichever is later, except, in the case of a wage or compensation grievance, the grievant or the Union may file a wage grievance within three (3) calendar years of the date on which the wage or compensation grievance arose. The grievant, the Union representative or the Union President shall sign the grievance. The grievance shall describe the violations alleged, including the article and section of this Agreement, and include a brief statement of facts sufficient to inform the principal or head administrator of the specific complaint and desired outcome.
