Eligibility for Annexation. The Parties agree that the termeligibility for annexation” shall mean any land that is contiguous to the corporate town limits via one or more points of connection, and that it is anticipated that the Town would annex lands eligible for annexation in the Estes Valley Planning Area at such time that a development proposal and annexation petition, including all required fees and supplemental information, is received from the property owner(s). When a town growth boundary is defined, lands within that area shall be considered for annexation at such time that a development proposal is presented. The Town represents that it will give due consideration to the desirability of annexing lands at such time that they become eligible for annexation based upon State annexation statutes (Title 31, Article 12, Colorado Revised Statutes (C.R.S.)).
