Common use of Eligibility for Job Competitions Clause in Contracts

Eligibility for Job Competitions. (a) An employee with less than six (6) months’ service in his/her entry position is not eligible to compete for a promotion unless he/she has the approval of his/her Supervisor. It is understood that such approval shall not be unreasonably withheld. (b) A regular employee with less than nine (9) months’ service in a position is not eligible to compete for a lateral move or demotion unless the employee has the approval of his/her Supervisor. It is understood that such approval shall not be unreasonably withheld. (c) Employees who have been laid off and are eligible for recall may apply for job postings.
