EMPLOYMENT AND TRANSFER. A. New employees shall be placed on the salary schedule as agreed between the employee and the Board. Anyone employed for more than half of any school year shall be given full credit for one (1) year of service toward the next increment step for the following year. B. Commission employees who move from part-time to full-time positions shall receive credit on the full-time salary guide on a prorated basis for their part-time experience with the Commission. C. Employees shall be notified of their contract and salary status for the ensuing year no later than the date dictated by N.J.S.A. 18A:27-10. D. Notice of vacancies shall be posted in the Commission's offices and a copy shall be mailed to the Association president. Such notice shall include a job description, qualifications and remuneration consistent with the established guide. Vacancy notices shall be posted at least ten (10) school days before the application deadline. E. Employees who wish to transfer to another position shall submit a request in writing to the Executive Director/Superintendent. F. An involuntary transfer shall occur only after a meeting between the employee to be transferred, his/her representative if the employee so chooses, and the Superintendent. At the time of the meeting, the employee will be notified of the reason for transfer. G. Notice of termination by either employer or employee may be given at anytime, giving to the other 45 days in writing of intention to terminate through June 30, 2007, and thereafter 35 days in writing of intention to terminate before or on July 1, 2008 and thereafter 30 days in writing of intention to terminate. H. MOESC shall internally post on the MOESC website any teaching vacancies for any vacant or newly created on-line teaching position.

EMPLOYMENT AND TRANSFER. A. Job Posting. Descriptions of bargaining unit job vacancies shall be posted and sent by e- mail to all bargaining unit members at least five (5) working days prior to public posting and distribution. Job postings shall include the following information: the date of the posting and the date the posting expires; department; job rank; starting salary range; basic function and responsibility; accurate required qualifications, including any educational requirements and applicable equivalent experience; and number of hours in the workweek. Prior to posting a vacancy, the department head will discuss with each member of the bargaining unit within the department who requests an opportunity for discussion, the possibilities, if any, of redistribution of subject area assignments within the department. The department head will make whatever reassignments, if any, they deem to be in the best interests of the library and the University. The University will make every effort to fill posted vacant positions within a reasonable amount of time. If a vacancy is not filled in thirty (30) days, the Union, upon its request, shall be informed as to the reasons.

Teachers who wish to transfer to another position shall submit a request in writing to the Superintendent. All requests for transfer shall be acknowledged by the Superintendent as having been received. D. Involuntary transfers may be required because of organizational and/or student needs. Involuntary transfers will be assigned by the Superintendent or his designee and the teacher affected will be given the reasons for the transfer and provided an opportunity to discuss the transfer with the Superintendent or his designee. Notice of transfer shall be provided in writing at least two (2) weeks prior to the occasion, where time constraints permit. E. Employees shall be notified of their contract and salary status no later than April 30th unless no contract agreement has been reached for the ensuing year. F. Employees qualified for home instruction vacancies will be given preference providing that home instruction requests are in the same areas of certification held by teachers. An eligibility list will be kept on file and assignments will be made according to this list. An employee's name may be removed from this list for good cause. G. A copy of all vacancy postings shall be sent to the Association President.

  • Employment and Training Administration The ratio of trainees to journeymen on the job site shall not be greater than permitted under the plan approved by the Employment and Training Administration. Every trainee must be paid at not less than the rate specified in the approved program for the trainee's level of progress, expressed as a percentage of the journeyman hourly rate specified in the applicable wage determination. Trainees shall be paid fringe benefits in accordance with the provisions of the trainee program. If the trainee program does not mention fringe benefits, trainees shall be paid the full amount of fringe benefits listed on the wage determination unless the Administrator of the Wage and Hour Division determines that there is an apprenticeship program associated with the corresponding journeyman wage rate on the wage determination which provides for less than full fringe benefits for apprentices. Any employee listed on the payroll at a trainee rate who is not registered and participating in a training plan approved by the Employment and Training Administration shall be paid not less than the applicable wage rate on the wage determination for the classification of work actually performed. In addition, any trainee performing work on the job site in excess of the ratio permitted under the registered program shall be paid not less than the applicable wage rate on the wage determination for the work actually performed. In the event the Employment and Training Administration withdraws approval of a training program, the contractor will no longer be permitted to utilize trainees at less than the applicable predetermined rate for the work performed until an acceptable program is approved.
