Eligibility for leave based upon the birth or adoption of a child expires at the end of the twelve (12) month period beginning on the date of birth or placement. A “rolling” twelve (12) month period measured backward from the date an employee uses any FMLA leave is used to determine the “twelve (12) month period” in which the twelve (12) weeks of leave entitlement occurs.
