Common use of Emergency Road Service Clause in Contracts

Emergency Road Service. When regularly assigned to perform service within switching limits, yard crews shall not be used in road service when road crews are available except in case of emergency. When yard crews are used in road service, under conditions just referred to, they shall be paid, in addition to the regular yard pay, actual miles run. However, in the event overtime occurs, they will be paid hours (8 hours yard rate at straight time plus time and one-half thereafter at yard rates) or miles (8 hours at yard rate plus actual miles run), whichever is greater. Question - When will road crews be considered as available? Answer - A road crew is available when rest is up and crew is subject to call.
