EMPLOYEE FILES. 28.1 PERSONNEL FILES 16.1 Bargaining unit members who are working as licensed employees, in accordance with NRS 391.313(b), may receive written letters of admonition. The first written admonition for a particular offense under NRS 391.312(1) may be removed from the file of an employee within a maximum of three (1999)

EMPLOYEE FILES. 28.1 PERSONNEL FILES (1999)a) The Employer and the Union agree that the Employer shall maintain confidential employee records. The Employee will advise Human Resources Services (HRS) immediately, via self service module, if there is any change in personal data, such as name, address or telephone number.

Upon request and within 1 week following the person(srequest, Employees will be provided with a photocopy of any requested documents from their file. The Employee is free to point out any alleged factual errors and proven errors will be corrected. On the same basis, an Employee will have access to their Employee Health/Return-to Work file, Employee Medical file, and the file containing their personal information held by their Supervisor.
(d) responsible Upon receipt of a written request from the Employee, HRS will confirm that all warnings and suspensions have been removed from their file and administered in accordance with Article 11.
(e) Subject to legal and/or statutory requirements, when HRS receives requests from an external agency for keeping personal or employment related information regarding an Employee, it will confirm employment only. Additional information shall only be divulged with the written authorization of the Employee.
(f) Access to personnel files will be limited to:
i. the Employee;
ii. staff in HR; and
iii. other authorized University officials in connection with personnel,administrative and/or labour relations matters
(g) All Employee Health / Return-to-Work files will be kept in an area separate from all other personnel files and under secure conditions.
(h) Access will be limited to the Employee and authorized persons within HR who have a legitimate reason to access such files. Whenever possible, it being understood that such persons may be required to supply information from those files to:
i. the Employee’s Supervisor to facilitate return to work, and where relevant, accommodation, excluding information disclosing diagnosis, the file shall be made available within two (2) work days of said request.
28.2.4 Written or verbal communication which is to be noted in the site file and is designation of a derogatory nature shall not medical specialist or the treatment type;
ii. the Employer’s authorized agents to administer the disability insurance program; or
iii. the Workplace Safety and Insurance Board (WSIB). Access to any other persons will only be placed in the employee'’ site file until the employee has had the opportunity to read the material. The employee shall acknowledge that he/she has read such material by affixing his/her signature on the actual copy to be filed. Such signature does not indicate agreement provided with the content of such material.
28.2.5 Anonymous communications shall not be maintained in the site file.

9. Administrators shall place in employees’ files information of a positive nature indicating competencies and achievements. Any such material received from concerned, 1977, employees responsible outside sources shall also be included in the employee’s file.

Whenever possible, the file shall be made available within two (2) work days of said request.
28.2.4 Written or verbal communication which is to be noted in the site file and is of a derogatory nature shall not be placed in the employee'’ site file until the employee has had the opportunity to read the material. The employee shall be given the opportunity to acknowledge that hes/she he has read such material materials by affixing his/her signature on the actual copy to be filed. Such filed with the understanding that such signature merely signifies that s/he has read the material to be filed and does not necessarily indicate agreement with the content of such materialits contents.
28.2.5 Anonymous communications 11. In the event that the Board or Administration wishes to use materials such as written memos or notes which are not a part of the official personnel file in making decisions concerning the promotion of an employee, the employee shall upon request be shown these materials and have one (1) week in which to make verbal and/or written comments about them. Letters in response to requests for references shall not be maintained in the site filecovered by this section.
28.2.6 An employee may request a review of his Site File and upon agreement and approval of the site supervisor material other than official records such as evaluations, attendance records may be removed. If an agreement cannot be reached regarding the removal of materials, the employee may initiate a grievance at Level II.
28.2.7 When an employee transfers to another school/location, the Site File shall be transferred to the new school/location as long as there is no grievance pending.

This material shall be submitted to the principal or supervisor and forwarded to the Assistant Superintendent, Human Resources, who shall place the material in the employee's file. The principal, supervisor or other administrative personnel shall have the right to attach comments to such materials subject to Section 28.1.2. No such material shall be deleted without the employee's consent.

The Superintendent shall review said documents in consultation with the Building Administrator. If the Superintendent agrees, in the Superintendent’s sole discretion, the documents shall be available at reasonable times for removed from the personnel file and destroyed.
10.2 The Board shall maintain only one personnel file per employee’s inspection in the presence of the person(s) responsible for keeping the files. Whenever possible, the and said file shall be made available stored at the HUUSD Central Office. The Board agrees to protect the confidentiality of the contents of employee personnel files, and it shall not establish separate confidential files. It is agreed that the Building Administrator of each school may maintain a working file; however, any document within two (2) work days that working file which does not become part of said requestan employee’s official personnel file within one year of the date it was written shall be destroyed.
28.2.4 Written 10.3 Each employee personnel file shall have a cover sheet attached to it. The sheet will be formatted to provide for the recording of the following information: the name and title of each person granted access to said file, the signature and date of each inspection of the file by a properly authorized person, and the purpose of each individual inspection.
10.4 Material derogatory to an employee’s conduct, services, character, or verbal communication which is to be noted in the site file and is of a derogatory nature personality shall not be placed in the employee'’ site ’s personnel file until unless the employee has had the an opportunity to read review the material. The employee shall acknowledge that he/she the employee has read had a chance to review such material by affixing his/her the employee’s signature on to the actual copy to be filed. Such , with the expressed understanding that such signature does not indicate in no way indicates agreement with the content contents. The Support Staff employee also has the right to submit a written answer to the material within thirty (30) days of such material.
28.2.5 Anonymous communications shall not be maintained in the site file.
28.2.6 An employee may request a review of his Site File and upon agreement and approval receipt of the site supervisor material other than official records such as evaluationsdocument(s); the employee’s answer will be reviewed by the Superintendent, attendance records may be removed. If an agreement cannot be reached regarding the removal of materialsor his/her designee, the employee may initiate a grievance at Level II.
28.2.7 When an employee transfers to another school/location, the Site File shall be transferred and attached to the new school/location as long as there is no grievance pendingfile copy.
