Employer Required Schedule Changes. A. (ODOT ONLY) The employer may adjust an employee’s daily start time(s) by two (2) hours or less. Employees shall not have their start time changed more than two (2) hours without seven (7) calendar days advance notice, except when work scheduling is controlled by a contractor or other conditions that are beyond the control of the immediate supervisor. Non- regular scheduling, including splitting a shift, may be necessary to fulfill the Agency’s responsibility for field inspection activities. In a split shift, the time an employee works in a day after twelve (12) hours from the time the employee initially reports for work is overtime. If the employee’s reporting time is changed without the required notice, the employee shall be entitled to a penalty payment of three (3) hours straight time pay in addition to the appropriate pay for the hours worked. The penalty payment shall continue until the notice requirement is met or the employee is returned to his/her prior reporting time(s), whichever occurs first.
