On-Call Duty. (a) Employees shall be paid one (1) hour of pay at the regular straight time rate for each six (6) hours of assigned on-call duty. Employees who are assigned on-call duty for less than six (6) hours shall be paid on a prorated basis. (b) An employee shall be assigned on-call duty when specifically required to be available for work outside his/her working hours and not subject to restrictions which would prevent the employee from using the time while on-call effectively for the employee’s own purposes. (c) No employee is eligible for any premium pay compensation while on on-call duty except as expressly stated in this Article. (d) On-call duty time shall not be counted as time worked in the computation of overtime hours worked but on-call pay shall be included in the calculation of the overtime rate of pay.

On-Call Duty. The term “On-Call Duty” shall be deemed to mean any period during which an Employee must be available to respond without undue delay to any request to return to duty. Employees required by the Employer to be on “On-Call Duty” shall receive:
On-Call Duty. ‌ 5.7.1 To provide for and take care of problems and emergencies that occur outside of regular working hours, certain employees will be assigned to weekly tours of on-call duty. On-Call duty does not include District-scheduled weekend work. 5.7.2 The regular tour of on-call duty for all bargaining unit members will be for a seven (7) day week beginning on Tuesday at 8:00 a.m. and ending the following Tuesday at 7:59 a.m. 5.7.3 The supervisor shall prepare and post an on-call duty assignment list, which will show all assignments and rotations of duty for a specified time period. Any changes or substitutions to the on-call schedule require supervisor approval. Assignment, distribution, and rotation of on-call duty will be made equally among the employees who have been previously qualified and certified for on-call duty, and the District will give reasonable accommodation to the employees when making up the roster. 5.7.3.1 Substitutions of on-call duty assignments, with prior written management approval, will be reasonably permitted so long as there is no inconvenience to other employees or the District. (a) Employees shall timely supply the designated request form to their supervisor for review and approval as early as possible but no later than two weeks prior to the requested substitution date. (b) Employees will be required to perform their original scheduled on-call duty assignment if their request for substitution is not approved. 5.7.3.2 When illness, injury, or other approved reasons prevent a bargaining unit member from serving on-call duty, the District will ask for volunteers. If no qualified unit member volunteers to cover the on-call duty assignment, the District will either assign a unit member the on-call duty or move all unit members up on the on-call duty roster. 5.7.3.3 An employee who volunteers to substitute in for another employee’s on-call duty assignment in a workweek when they have taken vacation time will not have such vacation time be considered hours worked as provided in Section 5.5.1.3 of this Article. 5.7.3.4 Bargaining unit members shall not work consecutive weeks of on- call duty. On-Call Duty a. On Call Duty is defined as being assigned to be available for a callout during a designated seven (7) day period. b. When management determines the need for a work group to have someone on call, management will solicit volunteers to be a part of the on-call pool on a six (6) week basis. Management will assign these qualified vol- unteers to the on-call schedule. If, at the discretion of the Company, there are insufficient volunteers among the Group 1 Craft employees whose predominant func- tions comprise the installation/maintenance of PBX equipment and the RMATS technicians, the Company may assign qualified employees to on-call duty by in- verse order of seniority. The employee must be avail- able to report for duty as required during the seven (7) day period assigned. c. An employee assigned to on-call duty shall be compen- sated for each week so worked at the rate of fifteen per- cent (15%) of the employee’s basic week’s pay. If cir- cumstances prevent the employee from fulfilling on-call responsibilities, the employee must immediately inform the supervisor. Compensation will be adjusted for the time the employee was unable to be on call. Subject to management approval, employees may volunteer for on- call duty for less than seven (7) days. On-Call Duty. 11.01 Both parties hereto accept that, in order to provide appropriate service and care to patients/residents/clients, on-call duty hours may be required to be worked by Employees in addition to regular hours. Positions that are designated for on- call duties must be approved by the Employer designate and the Regional Medical Lead of the Employer. During an on-call shift, an Employee may be required to take phone calls or attend on-site at the facility and perform duties if requested. The Employee is therefore required to be available to return to work without undue delay. On-call duty hours are not hours where an Employee is required to be, or remain, on-site at the facility awaiting assignment of work, including coverage of a shift for another employee or resident physician. 11.02 An Employee in a position with approved on-call duties shall not be scheduled to work such duties in excess of seven (7) times averaged over a four (4) week call period (1:4), unless otherwise agreed between the Employee and the Employer. The duration of an on-call shift shall be determined by the Employer, but shall not exceed twenty-four (24) hours. 11.03 An on-call stipend of $200.00 per twenty-four (24) hour on-call shift shall be provided. If two or more Employees split an on-call shift, the on-call stipend payable for that shift will be pro-rated between Employees that split an on-call shift. 11.04 In addition to the on-call stipend, an Employee that is on-call and required by the Employer to return to work shall be paid at time and one-half (1.5x) for all such hours worked. 11.05 Hours of on-call duty and hours worked after being called into work while on-call shall not be included in the calculation of bi-weekly hours of work (or hours of work over four (4) weeks for Part-Time Employees) or overtime hours of work. 11.06 If an Employee is on-call and is called into work for more than four (4) hours, of which more than two (2) full hours is after midnight and before 0600 hours, and the Employee is scheduled to work on a day shift commencing the morning immediately following the on-call shift, the Employer will make a determination of one of the following: (a) the Employee will be assigned administrative (non-clinical) duties during the day shift, and may be permitted to start the day shift at a later time but shall not suffer any loss of pay for the period of the shift that is not worked. Compensation for on-call duty shall be computed as follows: Workers shall be paid an hourly rate of $4.40 for time in which they are required to be in an on-call status, unless otherwise provided below. On-Call Duty. (i) If a Casual Employee is not working but the Employee is required by the Employer to be readily available to respond without undue delay to any request to report to work, the Employee shall be paid three dollars ($3.00) for each assigned hour of authorized on-call duty. (ii) On Named Holidays they shall be paid four dollars and twenty five cents ($4.25) per hour. (v) A Casual Employee who was not on call and is employed in a regularly scheduled full-time or part-time capacity and who is called back and required to report for work outside of their scheduled hours shall be paid for any one (1) call at either: (a) the overtime rate of two times (2X) the Basic Rate of Pay; or (b) four (4) hours at the Basic Rate of Pay; whichever is greater.
