EMPLOYMENT REFERENCES. Nothing in this Agreement shall prevent either party from stating the fact that Executive was employed by the Company, the address of his work location, the dates of his employment, his job titles and job duties, his rate of pay, or that he resigned from his position as the Chief Executive Officer and President and as a Director of the Company, and the termination of the Employment Agreement on the Effective Date.

The Company will provide employment references upon Executive’s request on the condition that Executive sign a notice and release provided by the Company.
