Any modification to this Agreement must be in writing, signed by the Parties, and identified as an amendment, except for certain mutually agreeable changes in the Study budget in Appendix 2 as set out in Section 12.7.2 below. The following Study budget changes may be documented by a modification letter signed by Sponsor: (1) increases in the total Study budget, with or without modification of the payment schedule, or (2) modification of the payment schedule with no change in total Study budget. If there is any conflict between this Agreement and any Appendices to it, the terms of this Agreement control. If there is any conflict between this Agreement and the Protocol, the Protocol will control as to any issue regarding treatment of Qualified Participants, and the Agreement will control as to all other issues. Následující změny rozpočtu klinického hodnocení mohou být doloženy dopisem týkajícím se příslušné úpravy podepsaným zadavatelem: (1) nárůst celkového rozpočtu studie s úpravou či bez úpravy harmonogramu plateb nebo (2) úprava harmonogramu plateb bez jakékoli změny celkového rozpočtu studie. Pokud dojde k rozporu mezi touto smlouvou a její přílohou, jsou určující podmínky této smlouvy. Pokud dojde k rozporu mezi touto smlouvou a protokolem, je určující protokol, pokud jde o otázky týkající se léčby způsobilých subjektů hodnocení, a smlouva, pokud jde o všechny ostatní záležitosti.
Entire Agreement Celistvost smlouvy. This Agreement, including its attachment(s), constitutes the sole and complete agreement between the Parties and replaces all other written and oral agreements relating to the Study. No Waiver/Enforceability Vzdání se uplatnění/Vynutitelnost Failure to enforce any term of this Agreement shall not constitute a waiver of such term. Neuplatnění jakéhokoli práva či podmínky této Smlouvy nezakládá domněnku vzdání se uplatnění takového práva či podmínky. If any part of this Agreement is found to be unenforceable, the rest of this Agreement will remain in effect. V případě, že bude kterákoli část této Smlouvy shledána jako nevykonatelná, zbytek této Smlouvy zůstane i nadále v platnosti.
