Equitable Charge. On the date of this Deed or otherwise within the time specified in Section 8 of the Note Subscription Agreement, Chargor, as beneficial owner of all of the Securities, and as continuing security for the due and punctual payment and discharge of all Secured Liabilities, charges in favour of Investor by way of first fixed charge all of the rights, title and interest from time to time held by Chargor in the Charged Assets.

Equitable Charge. You as beneficial owner and/or registered proprietor now charge in favour of us all of your estate and interest in any real property (including but not limited to any applicable land owned by you or described as your Street Address in the Credit Application if applicable) (“Land”) to secure payment of accounts rendered by us to you for the delivery and/or supply of Contract Works, including interest payable on these accounts and costs and legal costs on a full indemnity basis, incurred by us and including the costs of preparing and lodging a Caveat against the Land or removing the Caveat.

Equitable Charge. To secure payment of all monies which may become payable by the Customer to the Supplier the Customer HEREBY CHARGES with the due payment of those monies all of the Customer’s interest in the land described in this Commercial Credit Application and Supply Agreement and all other real property both present and future and the Customer consents to the Supplier lodging a caveat or caveats noting its interests pursuant to such charge. The Customer also agrees, if requested by the Supplier, to execute any other documents in registerable form to better secure this equitable charge. The Customer hereby agrees to indemnify the Supplier for all legal costs and fees in respect to such charge and caveat.
Equitable Charge. All Client’s Property shall be charged to CGS-CIMB by way of equitable charge as a continuing security for the payment of Liabilities, and: (a) the charge hereby created shall take priority over all other interests in Client’s Property; (b) if Client shall default in discharging on demand any sum hereby secured (the "Secured Indebtedness"), CGS-CIMB may at any time thereafter immediately upon giving notice to Client, retain, apply, sell or otherwise dispose of or cause to be sold or otherwise dispose of all or anyof Client’s Property charged in accordance with this clause 6 and apply the net proceeds thereof in or towards the discharge of the Secured Indebtedness at such time or times and in such manner and generally on such terms as CGS-CIMB may in its sole and absolute discretion think fit for which purposes CGS-CIMB may convert any moneys or proceeds of sale into any currency at such rate of exchange as it may in its sole and absolute discretion think fit; (c) CGS-CIMB is hereby granted an irrevocable power of attorney for and on behalf of and in the name of Client or otherwise to execute all documents and do all acts and things necessary or appropriate to sell or dispose of or complete the sale or disposal of all right, title and interest to and in any of Client’s Property liable to be sold or disposed of under this clause 6; and (d) the charge hereby created shall be in addition and without prejudice to any lien, rights of retention or other rights to which CGS-CIMB is or may become entitled under or by virtue of this Client Agreement.
